HomeMy WebLinkAbout01-044RESOLUTION AUTHORIZING THE SUBMITTAL OF A PLANNING GRANT APPLICATION FOR THE SMALL COMMUNITIES GRANT PROGRAM (Chico Urban Area Nitrate Compliance Program) WHEREAS, the California Regional Water Quality Control Board -Central Valley Region adopted Prohibition Order No. 90-126 on April 27, 1990 which addresses the density of on-site waste water disposal systems within the Chico Urban Area and the requirements to convert them to the local sanitary sewer system; and WHEREAS, the Butte County Board of Supervisors adopted the Chico Urban Area Nitrate Compliance Plan (Plan) on May 16, 2000 as the County's formal response to Prohibition Order No. 90-126; and WHEREAS, the Plan identifies the necessary policies to implement the coordination and conversion of approximately ?,800 dwelling units within the Chico Urban Area from on-site septic systems to a conventional sewer system; and WHEREAS, the Plan identifies that project financing will include a combination of State and Federal loans, grants, and local funding sources; and WHEREAS, California voters passed a $995 million band issue in November 1996 which provides $30 million in State grant assistance under Proposition 13 for small, needy communities; and WHEREAS, the State of California Water Resources Control Board administers the Small Communities Grant Program; and WHEREAS, on August 17, 2000 the State Water Resources Control Board adopted the 2000-2001 priority list for the Small Communities Grant Program which includes several neighborhoods that are identified in the Chico Urban Area Nitrate Compliance Plan; and WHEREAS, these neighborhoods are located entirely within the unincorporated portion of the Chico Urban Area, represent a divisible segment of the Chico Urban Area, has a median household income of less than $32,000, and encompasses a population of less than 5,000; and WHEREAS, the County of Butte may qualify for a grant award for the purposes of installing sewer infrastructure in the public right-of--way that may serve these neighborhoods; and WHEREAS, in March 2001 the County of Butte completed an income survey for approximately 400 households located within the Meadows Mobile I~-Tome Park, the Rancho Esplanade Mobile Home Park, and Country Villa/Windsong Apartments, and determined that the median household income is approximately $20,000. NOW, THEREFORE BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, as follows: 1. The Chief Administrative Officer is hereby authorized and directed to sign and file, for and on behalf of the County of Butte, a Financial Assistance Application for aloan/grant from the State Water Resources Control Board in the amount not to exceed $3,000,000 for the planning., design, and construction of sewer infrastructure necessary in accordance with the Chico Urban Area Nitrate Compliance Plan. 2. The County of Butte (County) hereby agrees and further does authorize the aforementioned representative or his/her designee to certify that the County has and will comply with all applicable state and federal statutory and regulatory requirements related to any federal and state loan/grants received; and. 3. The Chief Administrative Officer or his/her designee of the County is hereby authorized to negotiate a loan/grant contract and any amendments or change orders thereto and certify loan/grant disbursements on behalf of the County of Butte.
