PUBLIC NOTIFICATION PURSUANT TO
CHAPTER 33 OF THE BUTTE COUNTY CODE
WHEREAS, the groundwater within Butte County is a valuable resource to the
citizens of Butte County as well as the associated environment; and
WHEREAS, the citizens passed a groundwater protection ordinance by majority
vote in November 1996; and
WHEREAS, the groundwater protection ordinance has been codified as Chapter
3> of the Butte County Code; and
WHEREAS, Chapter '33 regulates the extraction of groundwater for transfer
outside of the county rn- the extraction of groundwater to be used in substitution of
surface water transferred outside the county under certain circumstances; and
W1~EREAS, a water transfer project under Chapter 33 may have the potential to
impact other water users within the county; and
WHEREAS, the County sees the importance of enhancing the public notification
process for potential impacted parties;
NOW, THEREFORE, BE. I"I' RESOI,VFD by the Board of Supervisors:
That the following guidelines be adopted regarding public notification of a permit
application by the Department of Water and Resource Conservation pursuant to
Chapter 33 of the Butte County Code:
l) Notification shall be made in a newspaper of general circulation within the
county, in font no smaller than l2, within the first three pages of the first
section of the newspaper.
2~ Notification shall be posted at the courthouse in Oroville and the Department
of Environmental Health in Chico.
3} Notification shall be posted prominently on the Department of Water and
Resource Conservation Website.
4) Notification shall be made to all landowners within 450 feet of the project
boundary as detned by the project application, or if the landowners are within
a municipal corporation, to that corporation.
5) Notification shall be made to all landowners identified as potentially impacted
in the hydrologic report.
6) Notification shall be made to all districts as defined in Chapter 33 and cities
within the county.
7) Notification shall be made to any interested party who has made a written
request to the Department of Water and Resource Conservation for such
notice within the last twenty-four (24) calendar months.
8) All Departmental notification shall be made within ten (10) calendar days of
ti]ing of the permit application pursuant to Section 33-9 of the Butte County
Code.
In addition, any applicant for a permit under Chapter 33 of the Butte County Code
shall be responsible for notification of parties pursuant to Chapter 23B-Sb of the
Butte County Code.
PASSED AND ADOPTED by the Butte County Board of Supervisors this
26th day of June 2001 by the following vote:
