HomeMy WebLinkAbout01-091}~ COUNTY QF BUTTE, STATE Q~ C~t~1F4RNlA ; hc~solufion No. of-oil RESOLUTION CALLING A PUBLIC HEARING rl'O DErI'ERMINE WHETHER PUBLIC NECESSITY, HEALTH, SAFETY, OR WELFARE REQUIRE THE FORMATION OF AN UNDERGROUND UTILITY DISTRIC'T' ON EAS"I' AVH:NUE FRO1~'I COHASSET ROAD TO 400 FEET EASTERLY (UNDERGROUND U'CILI'I'Y DISTRICT NO. 14B} WHEREAS, Chapter 26A of the Butte County Code establishes a procedure for the creation of underground utility districts and requires as the initial step in such procedures the holding of a public hearing to ascertain whether public necessity, health, safety, or welfare require the removal of poles, overhead wires, and associated overhead structures for supplying electric, communications, or similar or associated services in any such district; and WHEREAS, it has been recommended that such an underground utility district, hereinafter called District, be formed on Fast Avenue from Cohasset Road to 400 feet easterly (Underground Utility District No. 14B). N'OW, THEREFORE, BE IT RESOLVED AS FOLLOWS: Notice is hereby given that a public hearing will be held by the Board of Supervisors, of the County of Butte, on October 9, 2001, at the hour of 10:30 a.m., in t11e Board of Supervisors Room of the Administration Building, Oroville, California to ascertain whether public necessity, health, safety, or welfare require the removal of poles, overhead wires, and associated overhead structures for supplying electric, communications, or similar or associated service in the District described above. 2. At such hearing, all persons interested shall be given an opportunity to be heard. Said hearing maybe continued from time to time as may be determined by the Board of Supervisors. 3. The Clerk of the Board shall notify all affected property owners as shown on the last equalized assessment roll and utilities concerned of the time and place of such hearing by mailing a copy of this resolution to such property owners and utilities concerned at least ten (10) days prior to the date. 4. The area proposed to be included in the District is shown upon that certain map entitled East Avenue Underground District No. 14 B (Cohasset Road to 400 feet Easterly), dated October 2000, which is on frle in the offices of the Clerk of the Board and Director of Public Works of the County of Butte.
