RESOLUTION RAT'[FYING PROCLAMATION OF ~ LOCAL EMERGENCY AND
REQUI~S"I~WG THA"f "1'HE GOVERNOR PROCLAIM "fHE COUNTY OF BUTTE TO BE
IN A STATE OF EMERGENCY
WHEREAS, Section 8-5 of the Butte County Code empowers the Director of Emergency
Services of the County of Butte to proclaim the existence or threatened existence of a local
emergency when said County is affected or likely to be affected by a local emergency and the Board
of Supervisors is not in session; and
WHEREAS, conditions oI'extreme peril to the safety of persons and property have arisen
within said County, in that commencing on or about 7:45 a.m. on Thursday, September 6, 2001,
widespread fire which has resulted in the evacuation of populations in the communities of Yankee
I-Till and Concow. The Red Cross has opened shelters to accommodate displaced individuals. These
fires have caused and it is anticipated will continue to cause wholesale destruction of homes,
outbuildings, businesses and local watersheds.
WHEREAS. the aforesaid conditions of extreme peril did warrant and necessitate the
proclamation of the existence of a local emergency;
WHERF_.AS, at the time of the commencement of the said local emergency the Board of
Supervisors was not in session (and could not immediately be called into session); and
WHEREAS, the Director of Emergency Services of the County of Butte did proclaim the
existence of a local emergency within saki County on the 7th day of September, 2001; and
WIIERIAS, it is hereby found that local resources are unable to cope with the effects of said
f;mergellCV.
NOW, THEREFORE, IT IS HEREBY PROCLAIMED AND ORDERED that the
Proclamation of Existence of a Local Emergency, as issued by said Director of Emergency Services,
is hereby ratified and confirmed by the Board of Supervisors of the County of Butte;
IT IS FURTHER PROCLAIMED AND ORDERED that the Proclamation of Existence of
a Local Emergency shall be deemed to continue to exist until its termination is proclaimed by the
Board of Supervisors of the County of Butte; and
I"I~ IS F(1RTI~ER PROCI.A[MED AND ORDERED that during the existence of said local
emergency the powers, functions and duties of the emergency organisation of this County shall be
those prescribed by state law, by charter, ordinances, and resolutions of this County, and by the
County of Butte Emergency Ylan, as approved by the Board of Supervisors on September 1 1, 2001
CI~ IS I~ t IR'1'~IF:R ORDERED that a copy of this resolution be forwarded to the Governor of
C"aliiornia with the request that he proclaim the County of Butte to be in a state of emergency, and
with the turther request that the Governor request a Fresideniial Declaration.
1"[' IS EURTFIF,R ORDERED that a copy of this resolution be forwarded to the State Director
of the Oftice of Emergency Services.
1'I~ IS f~UR"fHER ORDERED that.i. Michael Madden, Emergency Services Officerofthe County
of Butte. is hereby designated as the authorized representative of the County of Butte for the purpose
of receipt, processing, and coordination of all inquiries and requirements necessary to obtain
available State and Federal assistance.
PASSED AND ADOPTED by the Butte County Board of Supervisors this l lth day of
September 2001, by the following vote:
