REGARDING AN APPLICATION
BY THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE
REQUESTING THE LOCAL AGENCY FORMATION COMMISSION
TO TAKE PROCEEDINGS FOR THE FORMATION
OF THE BUTTE COUNTY RESOURCE CONSERVATION DISTRICT
WHEREAS, the Board of Supervisors of the County of Butte approved Resolution 99-161
expressing their desire to initiate proceedings pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985, commencing with §56000 of the California Govenlment Code, for the
formation of a resource conservation district, to be known as the Butte County Resource
Conservation District {"the District") pursuant to Chapter 3 of Division 9 of the Public Resources
Code, commencing with X9151; and
WHEREAS, the Board of Supervisors of the County of Butte subsequently approved
Resolution 01-040 in April 2001, which superseded Resolution 99-161, excluding references to
urban development and urban run-off, but once again expressing their desire to initiate proceedings
pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, commencing with
X56000 of the California Government Code, for the formation of a resource conservation district,
to be known as the Butte County Resource Conservation District ("the District'") pursuant to Chapter
of Division 9 of the Public Resources Code, commencing with X9151; and
WHEREAS, notice of intention to hold a public hearing to consider adoption of this
resolution has been published pursuant to the requirements of Public Resources Code X9167 (b) and
Government Bode X6061, and said public hearing has been duly held; and
WHEREAS, the boundaries of the proposed District shall be the boundaries of the County
of Butte, including all the unincorporated areas therein, but excluding all the territory within the
Viva Resource Conservation District and all incorporated areas; and
WHEREAS, the sphere of influence of the District shall be coterminous with the boundaries
of the District and the District will provide services of a type not now provided or contemplated to
be provided by other governmental entities; and
WHEREAS, the formation of the District will be consistent with the General Plan of the
County of Butte, including but not limited to, the Conservation Element, the Agricultural Element
and the Safety Element; and
WHEREAS, the proposed District shall waive any claim to current or future property taY
revenues collected by the County of Butte; and
WHEREAS, this Board, in the public interest, will request that the Butte County Local
Agency Formation Commission {"LAFCo") waive application fee; and
WHEREAS, the District is proposed to be financed with a $6,000 start-up fund to be
provided by the County of Butte; will have unpaid Directors; will initially rely upon unpaid
volunteer staff; and expenses related to District formation, including the State Board of Equalization
fee, will, to the extent possible, be paid with revenues donated by members of the public and other
entities; and
WHEREAS, the reasons for farming the District are to obtain grants and other funding from
public and private sources to bring money and resources into Butte County to be made available on
a voluntary basis to individual property owners and other entities for addressing conservation issues
including, but not limited t.o: soil and water conservation, the control of runoff, the prevention and
control of soil erosion, and erosion stabilization, in open areas, agricultural areas, wildlife areas,
watershed areas,. timberlands and other non-urban lands and the treatment of such land according to
its needs; and
NOW, THEREFORE, BE IT RESOLVED that;
1. This Resolution of Application is hereby adopted and approved by the Board of Supervisors of
the County of Butte, and LAFCo is hereby requested to take proceedings for the formation of the
Butte County Resource Conservation District, according to the terms and conditions stated above
and in the manner provided by the Cortese-Knox Local Government Reorganization Act of 1985,
as amended.
2. The Chief Administrative Officer of the County of Butte, or his designee. is authorized and
directed to do all things necessan~ and desirable to complete the application to I,i1FCo and to submit
this Resolution to LAFCo, together with any and all required application forms and related
documents.
3. The Butte County Resource Conservation District "Trust Fund shall be and is hereby established
to accept donations from members of the public and other entities to assist in financing the formation
and on-going operations of the District.
4. LAFCo is requested, in the public interest, and in consideration of the fact that no budgeted
county funds are available to pay LAFCo fees, to waive any and all LAFCo fees in connection with
the said application and the processing thereof. Provided, however, that to the extent possible, actual
expenses incurred by LAFCo in processing the application shall be paid from "The Butte County
Resource Conservation District Trust Fund.
5. The activities of the Resource Conservation District shall be overseen by a board of directors,
appointed by the Board of Supervisors and shall consist of five (5) directors, one from each
supervisorial district.
