• ,,n •©• b~ ~~~ ^~• :~^ ^ ~ ^ • ~ ,~ ~ ~ • #r BOARD OF vUPERVISORS COUNTY OF BUTTE, STATE OF CALIFORNIA Reso~ufion No. 01-12~ RESOLUTION CALLING FOR AN ELECTION REGARDING THE FORMATION OF THE BUTTE COUNTY RESOURCE CONSERVATION DISTRICT WHEREAS, on April 10, 2001, the Butte County Board of Supervisors adopted Resolution No. OI-040 requesting that the Butte County Local Agency Formation Commission conduct proceedings for the formation of a resource conservation district to be known as the Butte County Resource Conservation District pursuant to Government Code Section 9167; and WHEREAS. the Butte County Local ~r~gency Formation Commission adopted Resolution No. OK 2001102 making determinations and approving the establishment of territory designated as 01-08 Formation of the Butte County Resource Conservation District: and WHEREAS, the Butte County Local Agency Formation Commission's Resolution No. 08 2001 !02 directed the Butte County Board of Supervisors, pursuant to Government Code Section 57007 and Public Resources Code Sections 91 S 1 through 9189, to call for, and give notice o£ an election to be held in the proposed district. NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of the County of Butte, State of California, as follows: "hhe Board hereby calls an election to be held within the proposed district on March 5. 2002. ``. That the proposed election be consolidated with the Statewide Primary election to be held on March 5, 2002. 3. Said election shall be held and conducted pursuant to the procedures specified in Part 3 of Division 10 of the Elections Code commencing at Section 10400, 4. The name of the proposed district shall be the Butte County Resource Conservation District. 5. The purpose of the district shall be: to obtain grants and other funding from public and private sources; to address soil and water conservation issues including the prevention of soil erosion and erosion stabilization in open areas, agricultural areas, wildlife areas. watershed areas, timberlands and other non-urban lands where these functions are not presently being addressed by another local agency or where a collaborative agreement has been reached with an affected local agency to manage an identified need; and to control water rui~i-off and sedimentation of natural waterways, provided such projects do not co-1t7ict with existing water reclamation or irrigation facilities operated by an existing local agency unless a cooperative agreement is appro~-ed by all affected agencies. The district, in exercising its functions. shall also coordinate and consult with the apprapriate mosquito abate-nent districts. 6. The approval is expressly conditioned upon the County providing adequate financial and in-kind support to the district to assure the continuing fiscal solvency of the district for at least {ive years, including at least the following: A. A commitment of at least $6,000 per year for general expenses of the district for five years. B. A contract between the district and the County providing the district with the following for at least t-ve years: 1. Insurance coverage for district activities. 2. Stai~fing. office assistance, and meeting space. 7. The boundaries of the district shalf be the boundaries of the County of Butte, including all the unincorporated areas therein, but excluding all the territory within the Vina Resource Conservation District and all incorporated areas; and 8. Following the approval of the electorate and the tiling of the Certificate of Completion by the LAFCo Executive Officer. the Board of Supervisors shall appoint the district directors according to the following formula: a total of five (5) directors shall be appointed, one from each supervisorial district.
