A RESOLUTION SUBMITTING
ORDINANCE N0.3759 TO THE VOTERS
AT THF. MARCH 5, 2002, ELECTION

WHF,REAS, the Board of Supervisors adopted Ordinance No. 3759, "An Ordinance
Amending Article IV of Chapter 2 of the Butte County Cade Redistricting the Supervisorial
Districts in the County of Butte," on August 28, 2001, as required by California Elections Code
Section 21500 et seq.; and
WHEREAS, a petition protesting the adoption of Ordinance No. 379 was circulated
among the voters of Butte County, and the petition sections were presented to the Board of
Supervisors on September 26, ?001; and
WHEREAS, the County Clerk/Registrar of Voters performed signature verification
procedures pursuant to Elections Code Section 9114 and 9146, and has prepared and presented
to the Board of Supervisors under Elections Code Section 9114 a Certificate of Sufficiency of
the protest petition; and
WHEREAS, the Board of Supervisors must either repeal Ordinance No. 3759 or submit
the ordinance to the voters pursuant to Elections Code Section 9145; and
WHEREAS, the next regularly scheduled county election pursuant to Elections Code
Section 914 and 1405 is the March 5, 2002, consolidated statewide election.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors hereby
submits Ordinance No. 3759 to the voters at the March 5, 2002, regularly scheduled county
election; and
That the County Clerk/Registrar of Voters is ordered and directed to undertake their
ministerial election duties to prepare ballot titles, titles and summaries, and other ballot materials
to effectuate this Resolution; and
That the ballot question on Ordinance No. 3759 shall be: "Shall Ordinance No. 3759
adjusting supervisorial district boundary lines to reflect shifts in population, as required by state
and federal "one-person, one-vote" standards, be adopted?'°
PASSED AND ADOPTED by the Butte County Board of Supervisors this 20`h day of
Navember 2401 by the fallowing vote:
AYES: Supervisors Beeler, Yamaguchi and Chair Josiassen
NOES: Supervisors Dolan and Houx
ABSENT: None
NOT VOTING: None
