DI-134 A RESOLUTION SUBMITTING ORDINANCE N0.3759 TO THE VOTERS AT THE MARCH 5, 2002, ELECTION WHEREAS, the Board of Supervisors adopted Ordinance No. 3759, "An Ordinance Amending Article IV of Chapter 2 of the Butte County Code Redistricting the Supervisorial Districts in the County of Butte," on August 28, 2001, as required by California Elections Code Section 21500 et seq.; and WHEREAS, a petition protesting the adoption of Ordinance No. 3759 was circulated among the voters of Butte County, and the petition sections were presented to the Board of Supervisors on September 26, 2001; and WHEREAS, the County ClerklRegistrar of Voters performed signature verification procedures pursuant to Elections Code Section 9114 and 9146,. and has prepared and presented to the Board of Supervisors under Elections Cade Section 9114 a Certificate of Sufficiency of the protest petition; and WHEREAS, the Board ol` Supervisors must either repeal Ordinance No. 3759 or submit the ordinance to the voters pursuant to Elections Code Section 9145; and WHEREAS, the next regularly scheduled county election pursuant to Elections Code Section 9145 anal 1405 is the March 5, 2002, consolidated statewide election; and WHEREAS, on November 20, 2001, the Board of Supervisors adopted Resolution 01- 134, aresolution submitting Ordinance 3759 to the voters at the March 5, 2002, election, and subsequent information has necessitated that Resolution 01-134 be amended; NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors hereby submits Ordinance No. 3759 to the voters at the March 5, 2002, regularly scheduled county election; and That the election shall be consolidated with the statewide primary election to be held on March 5, 2002. That the election shall be held and conducted pursuant to the procedures specified in Part 3 of Division 10 of the Elections Code commencing at Section 10400. For purposes of this election, and Ordinance No. 3759, the "County voters" and the "County electorate" shall include all voters in the County including the voters in the unincorporated areas of the county. Pursuant to Elections Code Section 13120, the question to be submitted to the voters shall read as follows: REDISTRICTING ORDINANCE, RF_,FF.RCNDUM Shall Ordinance Number 3759 adjusting supervisorial district boundary lines to reflect shifts in population, as required by state and federal "one- person, one-vote" requirements, be adopted? YES L ~ NO [ That the County ClerklRegistrar of Voters is ordered and directed to undertake her ministerial election duties to prepare ballot titles, titles and summaries, and other ballot materials to effectuate this Resolution, and That the ballot question on Ordinance No. 3759 shall be: "Shall Ordinance No. 3759 adjusting supervisorial district boundary lines to reflect shifts in population, as required by state and federal "one-person, one-vote" requirements, be adopted?"
