HomeMy WebLinkAbout01-145~,.•Q~'svP,~••., ~~+ w :~{r • 1 • I'~ . ~. -~.~A •~ i a ~ ~i ~,1 ~~quw~~~~ V• •~,~~~ L'OUl~t~i~,~ BOARD OF SU PERV ISt~RS COUNTY OF BUTTE, STATE OF CALIFORNIA ~2esolufion No. of-lt~s A RESOLUTION AUTHORIZING SPECIFIED BOARD MEMBERS TO FILE BALLOT ARGUMENTS CONCERNING MEASURE "B," A REFERENDUM MEASURE TO BE SUBMITTED TO COUNTY VOTERS AS PART OF THE MARCH 5, 2002 CONSOLIDATED STATEWIDE ELECTION WHEREAS, on August 28, 2001, the Board of Supervisors of the County of Butte approved Ordinance Number 3759, Amending Article IV of Chapter 2 of the Butte County Code by Redistricting the Supervisorial Districts in the County of Butte; and WHEREAS, said Ordinance Number 3759 was challenged on September 26, 2001 by a referendum petition protesting it pursuant to Elections Code Section 9144; and WHEREAS, the Butte County Clerk-RecorderjRegistrar of Voters certified on November 6, 2001 that the signatures on said referendum petition had been found sufficient; and WHEREAS, an November 20, 2001, the Board adopted Resolution O1-134, submitting Ordinance Number 3?59 to the voters of the County at the March 5, 2002 election; and Page 7_ WHEREAS, on December 3, 2001, the Board adopted Resolution 01-139, amending and superseding Resolution 01-134, submitting Ordinance Number 3759 to the voters of the County at the March 5, 2002 election; and WHEREAS, the Butte County Clerk-Recorder/Registrar of Voters, the elections official of the County of Butte, has determined that Ordinance Number 3759, will be designated as "Measure 'B,"' on official elections materials distributed to Butte County voters and on the official ballots to be used far the March 5, 2002 election; and WHEREAS, Elections Code Section 9162 permits county boards of supervisors and individual county supervisors to file written arguments for or against county measures with the county elections official; and ^4THEEAS, Elections Code Section 9163 requires county elections officials to establish a deadline prior to each election, after which no arguments far ar against any county measure may be submitted for printing and distribution to the voters; and WHEREAS, the elections official of the County of Butte has established Decerrlber 17, 2001 as the deadline prior to the March 5,2002 election, after which no arguments for or against any County ballot measure may be submitted for printing and distribution to the County voters; and WHEREAS, the Board wishes to authorize individual Board members to file a written argument and rebuttal in support of Measure "B" with the elections official of the County of Butte; and Page 2 NOG^~~, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of the County of Butte, State of California, as follows: 1. The Board hereby authorizes the following individual Board members to file a written argument and rebuttal in support of Measure "B" with the elections official of the County of Butte: Chair Josiassen. Supervisor Yamaguchi and Supervisor Beeler may join in the argument. 2. The above authorization is permissive and shall not require the board members authorized to submit ballot arguments concerning Measure "B" to the elections official to do so. 3. The above authorization shall not preclude the Board members from joining other individuals who are not Board members in filing ballot arguments concerning Measure "B" with the elections official, provided that each argument contain no more than five signers and otherwise complies with Elections Code Section 9164.
