HomeMy WebLinkAbout02-040t~ } 'H. ~ i~ COUN'T'Y ~ OF' ~3UTTE, ~TAT~ pig ~~~ Resolufion No. oz-040 RESOLUTION AUTHORIZING USE OF RULE 20A CREDITS ALLOCA'hED BY PACIFIC GAS AND ELECTRIC COMPANY TO TILE COUNTY OF BUTTE IN THE CITY OF CHICO PURSUANT TO DECISION NOS. 7307$ AND 82-01-18 OF THE CALIFORNIA PUBLIC UTILITIES COMMISS[ON ti~'HEREAS, by Resolution No. 104 00-Ob of the City Council of the City of Chico, a public hearing was called March 20, 2001, at the hour of 7:30 p.m., in the City of Chico City Council Chambers, 421 Main Street, Chico, Califonlia, to ascertain whether the public necessity, health, safety, or welfare required the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service, within that certain area of the City of Chico on Cohasset Road from Pillsbury Road to Azalea Avenue; and WHEREAS, notice of such blearing was given to all affected property owners and utilities concerned in the manner and for the time required by laev; and WHEREAS, such hearing was duly held, and all interested persons were given an opportunity to be heard; and WHEREAS, the City Council of the City of Chico, pursuant to Resolution 104 Ot?-01 ol~the City of Chico, has declared and determined that certain area ~~ ithin the City oI~ Chico described as Underground Utility District No. 1S -Cohasset Road (Gom Pillsburv Road to :'~ialca A~~cnue,} as i»c>rc spccilically described in E~hibil "A" alld delineated in L:xhibit "R.. ~ittached and ciltitled ~~C1~1 l~ (~l~ CHICO, UNDERGR©UND DISTRICT NO. 1 S, COHASSET ROAD, (PILLSBURY ROAD TO AZALEA AVENUE)", to be an underground district for conduits, wires, and associated appurtenances for the purpose of supplying electric, telephone, cable television, and other similar associated service by means of electrical materials or devices; and WHEREAS, the Underground Utility District created by said Resolution 104 00-O1 of the City of Chico is in the general public interest for the following reasons: The undergrounding to be accomplished will avoid or eliminate an unusually heavy concentration of overhead distribution facilities; ~. The streets, roads, or rights-of--way in the district are extensively used by the general public and carry a heavy volume of pedestrian and vehicular trafCc; and WHEREAS, the area contained within Underground Utility District No. 15 -Cohasset Road (from Pillsbury Road to Azalea Avenue) is of particular countywide interest by reason of its commercial uses, which benefit County and City residents. NO`V, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County of Butte, pursuant to Decision Nos. 73078 and 82-D1-I$ of the California Public Utilities Commission, hereby authorizes the utilization of the necessary Rule 20A allocation credits, estimated to be approximately $600,000, from the cumulative amount currently allocated by Pacific Gas and Electricity Company to the County of Butte for the year 2002 for expenditure on the underground utility conversion project to be carried out in said Underground Utility District No. 15 -Cohasset Road (from Pillsbury Road to Azalea Avenue) within the City of Chico.
