A RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS
ALLOWING THE DIRECTOR OF "THE DEPARTMENT OF DEVELOPMENT
SERVICES TO AUTHORIZF, THE CITY OF CHICO TO ISSUE BUILDING PERMITS
FOR PROPERTY IN THE PROCESS OF BEING ANNEXED TO THE CITY OF CHICO
WHEREAS, in order to accommodate the desire of property owners who propose to
annex their property to the City of Chico, it is necessary for the Butte County Board of
Supervisors to allow the Director of Development Services (DIRECTOR) to authorize the City
of Chico to issue Building Permits when property owners have requested annexation to the City
of Chico; and
WHEREAS, the DIRECTOR is requesting that the Butte County Board of Supervisors
implement a part of the Municipal Affairs Agreement, Section 1.03 a (iii). by authorizing the
Director to authorize the City of Chico to issue Building Permits, including the checking of
plans, issuing permits, conducting inspections, and collecting fees for property in the process of
being annexed to the City of Chico; and
WHEREAS, said authorization will be approved by the DIRECTOR subject to the
following certifications of the City of Chico that:
1. It has requested authorization to issue said Building Permit and stated it will
assume the County's responsibilities for assuring compliance with State and
Federal laws.
2. It has adopted a Resolution requesting the annexation of the property for which a
Building Permit is requested and is diligently pursuing annexation.
3. It has accepted and is processing a tentative map, under Government Code
Section 66454, if the property is to be subdivided.
4. It has designated the property as within its sphere of influence and prezoned the
property for the use for which the Building Permit is to he issued.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County
of Butte hereby adopts this Resolution allowing the Director of the Department of Development
Services to authorize the City of Chico to issue Building Permits subject to the certifications set
forth above.
PASSED AND ADOPTED by the Butte County Board of Supervisors on this 9r" day of
April, 2002. by the following vote:

NOES: None
ABSENT: None
NOT VOTING: none
