M ,,{ + • i iij'~~1+++•+nw+++++••• .~~• • 1 ~ ~ , ~' O U 1 ~I' ; ,~~ ~ 1 BOARD OF SUPRRVISORS COUNTY OF BUTTE, STATE OF CALIFORNIA ~esolufion No. oz-o6;~ RESOLUTION FORMING THE BUTTE COUNTY RESOURCE CONSERVATION DISTRICT WHEREAS, on April 10, 2001, the Butte County Board of Supervisors adopted Resolution No. O 1-040 requesting that the Butte County Focal Agency Formation Commission conduct proceedings for the formation of a resource conservation district to be known as the Butte County Resource Conservation District pursuant to Government Code Section 9167; and WHEREAS, the Butte County Local Agency Formation Commission adopted Resolution No. 08 2001102 making determinations and approving the establishment of territory designated as 01-08, Formation of the Butte County Resource Conservation District; and WHEREAS, the Butte County Local Agency Formation Commission's Resolution No. 08 2001/02 directed the Butte County Board of Supervisors, pursuant to Government Code Section 57007 and Public Resources Code Sections 9181 through 9189, to call for, and give notice of; an election to be held in the proposed district; and WHEREAS, on October 23, 2001, the Butte County Board of Supervisors adopted Resolution No. 01-125 calling for an election regarding the formation of a Resource Conservation District; and WHEREAS, on November 20`'', 2001 the Butte County Board of Supervisors adopted Resolution Na. 01-135 calling for an election regarding the formation of a Resource Conservation District to be held on March 5, 2002 consolidated with the Statewide Primary election; and WHEREAS, the Statement of Votes Cast for Measure C to form the Resource Conservation District indicate the majority of votes cast were in favor of the formation of the Resource Conservation District; and WHEREAS, on April 9, 2002, the Butte County Board of Supervisors accepted and approved the Certification of the Statement of Votes Cast at the Consolidated Primary Election held on March 5, 2002; NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of the County of Butte, State of California, as follows: A Resource Conservation District is duly organized pursuant to Governmental Code Section 57007 and Publie Resources Code Section 91$ i through 9189 within the unincorporated areas of the County of Butte. 2. The name of the proposed district shall be the Butte County Resource Conservation District. 3. The purpose of the district shall be: to obtain grants and other funding from public and private sources; to address soil and water conservation issues including the prevention of sail erosion and erosion stabilization in open areas, agricultural areas, wildlife areas, watershed areas, timberlands and other non-urban lands where these functions are not presently being addressed by another local agency or where a collaborative agreement has been reached with an affected local agency to manage an identitied need; and to control water run-off and sedimentation of natural waterways, provided such projects do not conflict with existing water reclamation or irrigation facilities operated by an existing local agency unless a cooperative agreement is approved by all affected agencies. The district, in exercising its functions, shall also coordinate and consult with the appropriate mosquito abatement districts. 4. "I'he County shall pravide financial and in-Lind support to the district to assure the continuing fiscal solvency of the district for at least five years, including at least the following: A. A commitment of at least $6,000 per year for general expenses of the district for five years. B. A contract between the district and the County providing the district with the following for at least five years: Insurance coverage far district activities. 2. Staffing, office assistance, and meeting space. 5. The boundaries of the district shall be the boundaries of the County of $utte, including all the unincorporated areas therein, but excluding all the territory within the Vina Resource Conservation District and all incorporated areas; and 6_ Following the tiling of the Certificate of Completion by the LAFCo Executive Officer, the Board of Supervisors shall appoint the district directors according to the following formula: a total of five (5) directors shall be appointed, one from each superv°isorial district.
