HomeMy WebLinkAbout02-087~~••0~ SUP~+ • ~~ ~ ~~ • ~~~.n~~ ~ t ~~ ~i ~ M ~.Q• .~.r • ~ 7t • • ~ ^ • ~ ~ ~ *+ ~~~~j~~ ~~i~~+•1 RESOLUTION FOR SUMMARY ABANDONMENT AND RIGHT-OF-WAY EXCHANGE FOR PORTIONS OF BREMNER COURT (DURHAM LAND ESTATES SUBDIVISON, PHASE 2) WHEREAS, the County previously approved the map of Durham Land Estates Subdivision, Phase 2, filed for record July 31, 2001 in Book 152 of Maps at page 29, Butte County Records; and WHEREAS, said map included the offer of dedication in fee simple of Bremner Court for public street, public services and all other public purposes, said offer being accepted by the County on the face of the map; and WHEREAS, Bremner Court was constructed approximately 15 feet longer than allowed for in the dedicated public right-of--way accepted by the County; and WHEREAS, the affected property owners desire the County to abandon those portions of Bremner Court no longer needed for public street purposes, described in Exhibit "A" and depicted on Exhibit "B"; and WHEREAS, the affected property owners desire to dedicate in fee simple to the County of Butte for public street, public services and all other public purposes, Bremner Court at its new length, as described in Exhibit "C" and depicted on Exhibit "D" attached hereto; and WHEREAS, the newly dedicated portions of Bremner Court as described in said Exhibit "C" are of equal or greater value than those portions to be abandoned as described in said Exhibit "A"; and WHEREAS, said abandonment of those portions of Bremner Court will not cut off any access to any person's property, which, prior to abandonment, adjoined said Bremner Court, and will not terminate any public service easement. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, as follows: In exchange for the dedication in fee simple of those portions of Bremner Court described in Exhibit "C" and depicted on Exhibit "D", attached hereto, those portions of Bremner Court described in Exhibit "A" and depicted on Exhibit "B", attached hereto, are hereby summarily vacated and abandoned pursuant to Streets and Highways Code Division 9, Part 3, Chapter 4, commencing with Section No. 8330, reserving there from the underlying Public Service Easement as dedicated and accepted on said subdivision map.
