HomeMy WebLinkAbout02-103• ~~ ~~~ilr~-..nn~~ ~O` ~~~ '~°' BOARD OF SUPERVISORS ~~~ ,~,~~' 4 ~~i „~ ~ ~;~, ~ COUNTY OF BUTTE, STATE CJF CALIFORNIA C.~ ~ ~,? `•:~ L'OUN~••' Reso~ufion No, a~-~~,~ ~'f+i I ~ ~ 11 ~~~~ RESOLUTION OF THE BU'I"I'E COUNTY BOARD Oh' SUPERVISORS APPROVING THE APPLICA'T'ION FOR STATE OFF-HIGHWAY VEHICLE GRANT ENTTTLED `BUTTE MEADOWS O&M" FOR SNOW RL+'MOVAL FOR RECREATIONAL PURPOSES WHEREAS, people of the State of California have enacted the ©ff-Highway Motor Vehicle Recreation Act of 1988, which provides funds to the State of California and its political subdivisions for planning, acquiring, developing, operating, conserving, and maintaining off- highway vehicle recreation; and WHEREAS, the Off-F~ighway Motor Vehicle Recreation Division within the State of California Department of Farks and Recreation has been delegated the responsibility to administer the program; and WHEREAS, procedures established by the California Department of Parks and Recreation require the Applicant to certify by Resolution the approval of applications before submission to the State; and WHEREAS, this project appears on or is in conformance with this jurisdiction's adopted general or master plan and is compatible with the land use plans of those jurisdictions immediately surrounding this project. NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors hereby: 1. Approves the filing of an application for an Off-Highway Vehicle Grant; 2. Certifies that this agency understands its legal obligations to the State upon approval of the grant; 3. Certifies that this agency understands the California Public Resource Code requirement that acquisition and development projects be maintained to specific conservations standards; 4. Certifies that the project will be well maintained during its useful life; 5. Certifies that this agency will implement the project with diligence once funds are available and a Project Agreement has been consummated between the State and this agency; 6. Certifies that this agency will provide the required matching funds (as applicable); 7. Certifies that the public and adjacent property owners have been notified of this project (as applicable); and 8. Appoints the Chief Administrative Officer as agent of the County of Butte to conduct all negotiations and to execute and submit ail required documents, including but not limited to, applications, agre.e.ments, amendments, payment requests, etc., which may be necessary for the completion of the project.
