HomeMy WebLinkAbout02-152~~ ~ e~: ~, ~ +k {i-~~ ~ ~: , ~3~ J~- f~ ~3 ~- ~ ~ U P E R V I v C.) !~ ~ ~P ~x ~~~: ~~ ,;, :'~:,.i .' - C~3IJNTY `C3F BlJTTE, STATE CJF CAi.MFOR1~IiA" ~~~~ ; ~.~~ M fit! t~rr- l~t'SO11tf10i1 !U0. 02-152 RESOLUTION REGARDING THE FINDING OF NO SIGNIFICANT IMPACT A5 A RESULT OF THE QUINCY-OROVILLE HIGHWAY PROJECT CA PFI-I 1.19-2{3) & 119-2{4) WHEREAS, The Federal Highway Administration has prepared an environmental assessment (EA) and adopted a Finding of No Significant Impact (FONSI) pursuant to the 1~lational Environmental Policy Act (NEPA) for the California Forest Highway 119, Oroville- Quincy Road-Phase 1 & 2, Project CA PFH 119-2(3) & 119-2(4); and WHEREAS, The California Environmental Quality Act (CEQA) Guidelines, Section 15225 provides that a lead agency may use a federal document in place of an EIR or Negative Declaration to satisfy environmental review requirements under CEQA; and WHEREAS, The County of Butte action for the Quincy-Oroville project involves acquisition of rights-of--way through certain public and private owned lands, and the completion of certain tasks as defined in the project agreement dated May 24, 2002, and evaluated in the Environmental Assessment; and WHEREAS, The Board Of Supervisors of Butte County finds as follows: 1. The Environmental Assessment, Findings of No Significant Impact, prepared and approved by the Federal Highway Administration, satisfies both substantive and procedural requirements for environmental review under CEQA. 2. The project is a federal project, and is therefore not subject to the fee requirements of the California Department of Fish and Game. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County of Butte, State of California, hereby concludes that the proposed project has complied with all of the requirements for environmental review under CEQA, and that the Butte County Public Works Department is authorized to pursue the acquisition of rights-of--way from certain public and private property owners as required for the project, and to complete tasl{s as defined in the project agreement.
