RESOLUTION SUPPORTING THE PRIVACY AND SECURITY OF HEALTH
INFORMATION AND AUTHORI7ING THE DEVELOPMENT OF
ADMINISTRATIVE POLICIES AND PROCEDURES TO COMPLY WITH
HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT
WHEREAS, the Health Insurance Portability and Accountability Act (HIPAA)
was passed by Congress and signed into law in 1996; and
WHEREAS, HIPAA, among other intentions, was designed to reduce the
administrative burden on health care providers, payers, and healthcare clearinghouses;
and
WHEREAS, HIPAA, among other intentions, was designed to further secure
access to individually identifiable health information; and
WHEREAS, Butte County provides and pays for health care; and
WHEREAS, Butte County is not exempt from complying with HIPAA or its
Rules and Regulations; and
WHEREAS, privacy is a fundamental right ofall citizens; and
WHEREAS, it is in the interests of patients and healthcare providers alike that
medical and health records be secure from accidental or intentional misuse; and
WHEREAS, individually identifiable health information during the rapid growth
of integrated healthcare delivery systems requires greater use of integrated health
information systems; and
WHEREAS, Butte County has, within its service structure, many components,
departments, and offices that receive, collect, store, use, and transmit individually
identifiable health infarmation and medical records and files protected under Federal and
State law.
NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of
Supervisors hereby supports, encourages and. requires the protection and confidentiality
of individually identifiable health information and medical records consistent with and
pursuant to all Federal and State health information privacy and security laws,
regulations, and policies, including, but not limited to, the Health Insurance Portability
and Accountability Act of 199b.
BE IT FURTHER RESOLVED that the Butte County Board of Supervisors
hereby directs the development of County administrative policies and procedures that
serve to guide and direct compliance implementation of such Federal and State laws,
regulations, and policies.
PASSED AND ADOPTED by the Butte County Board of Supervisors on this 8`~'
day of October 2002 by the following vote:
AYES: Supervisors Beeler, Dolan, Roux, Yamaguchi and Chair Josiassen
