HomeMy WebLinkAbout02-194~• • ~~ • ~:• ;< .a. .• . ~: .*. .. . -~ .~ •`'~ •' "'} ~ ''Q ~~~~ CQV~~~~~~ RCSOLUTION A[3ANDONING A PUBLIC RIGHT OP' WAY CROWN POINT ROAD WHERCAS, This matter came o-1 regu]arly for hearing before the Board of Supervisors of the County of Butte, State of California, on November l2, 2002, in the Board Chambers, Butte County Administration B~-ilding, 25 County Center Drive, Oroville, California; and, WHCREAS, it appearing to said Board that notice of the time and place of the hearing Oll the petltlOR fol' the abandonment Of t~1C pLlbhC rlght Of Way 111 gLleStI0I1 WaS duly and regularly given as required by law; and WHERCAS, testimony and evidence, both oral and documentary, having been produced at said hearing, from which said Board now finds that: (1) there is no possibility the proposed abandonment of this public right of way may have a significant effect on the environment, and it is therefore not subject to the California Environmental Act; (2) the proposed abandonment is in conformance with the Butte County General Plan; and (3) the public right of way in question, as hereinafter described is unnecessary for present or prospective public use. NOW, THCRCP'ORC, l3C IT RCSOLVEU by the Board of Supervisors: l . That the public right of way situated in the County of Butte, State of California, as hereinafter more particularly described, arc hereby abandoned pursua-1t to Chapter 3 of Part 3 of Division 9 of the California Streets and I [ighways code (commencing with Section 8320). 2. That said public right of way so abandoned are located in the unincorporated area of the County of Butte, State of California, are identified as Crown Point Road and are more particularly described as follows: Being a portion of that certain County of Butte road known as "Crown Point Road", lying within the Northwest one-quarter of the Southeast one-quarter of Section 24, Township 23 North, Range 2 East, M.D.M., and also being shown on that certain State of California, Division of I-Iighways ABANDONMENT MAP and RELINQUISI-IMENT MAP for relinquishment to the COUNTY OF BUTTE under Relinquishment Request No. 24145-X in State Highway Map Book No. 4 at Pages 27 & 28, on file in the Office of the Recorder, CoLU~ty of Butte, State of California, and also being more particularly described as follows; Bcgin-ling at a point on the centerline of said Colmty of Butte road known as "Crown Point Road", said point also being on the south line of said Northwest one- N'i'~LU Prujcd~AHU~Blliau 050-(J10-U 19 dt!!SOLUIION ABiANUUVIA(. Cruwn Point ILOad.duc quartcr of the Southeast one-quartcr of Section 24, and also being 1/l0 mile, more or less, easterly of State I [ighway 32. THENCE, Northerly 5/10 of a mile, more or less, along said centerline of Crown Point Road to a poi-1t lying on the North line of said Northwest one-quarter of the Southeast one-quarter of Section 24, said point also being on the most southerly bounda-y line of that certain parcel of land currently owned by the United States of America, and said point being the northerly end of the County of Butte maintai-1ed portion of Crown Point Road. Reserving therefrom an easement for ingress, egress and public services purposes for the benefit of all that portion of the Southwest one-quartcr of the Northeast one- quarter of said Section 24 lying southerly of State Highway 32. Also reserving therefrom a public services easement for the benefit of Pacific Gas and Electric and Pacific I3e11, and their heirs or assigns, for the operation, maintenance, removal, renewal, replacement and enlargement of the existing public service facilities together with the --ight of ingress and egress thereto, within the Crown Point Road right of way abandoned by this Resolution. 3. That a map showing the right of way hereby abandoned is on file in the Office of the Butte County Department of Public Works, 7 County Center Drive, Oroville, California 95965. That the clerk of thisBoard shall cause a certified copy of this Resohrtion, with the seal of the Board of supervisors of the County of Butte, State of California, to be recorded in the Office of the Recorder of the County of Butte, State of California.
