A RESOLUTION AMENDING THE CONTRIBUTION AGREF.MF,NT, DISTRICT
AGREEMENT NO. 03-0238, BETWEEN THE STATE OF CALIFORNIA,
DEPARTMENT OF TRANSPORTATION, AND COUNTY OF BUTTE, FOR THE
INSTALLATION OF A TRAFFIC CONTROL SIGNAL AND SAFETY LIGHTING
PROJECT ON STATE ROUTE 99 AT ESTATES DRIVE
WHEREAS, the County has requested a cooperative agreement for improvements to
State highways within Butte County and the City of Chico, pursuant to Streets and Highways
Code Sections 114 and 130;
WHEREAS, the California Department of Transportation requires the County's
acceptance of the terms of the proposed Contribution Agreement, District Agreement No. 03-
023$, between the State of California, Department of Transportation, and the County of Butte,
for the installation of a traffic control signal and safety lighting project on State Route 99 at the
Estates Drive intersection.
WHEREAS, the traffic control signal and safety lighting project on State Route 99 at
Estates Drive is necessary for improved traffic safety at this intersection.
NOW THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County
of Butte, State of California, that said County of Butte approves Attachment A to said
Contribution Agreement, District Agreement No. 03-0238, between the State of California,
Department of Transportation, and the County of Butte, for the installation of a traffic control
signal and safety lighting project on State Route 99 at the Estates Drive intersection and
authorizes the Chair to execute Attachment A.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of
California, this 25th day of February, 2003, by the following vote:

ATTACHMENT A
This letter serves as an interpretation of proposed Contribution Agreement No. 03-0238
(Agreement). County agrees that, in the event that the 2003/04 federal fiscal year Hazard
Elimination Safety (HES) program funds in the amount of $110,000 are not encumbered against
the Agreement as the guaranteed County fund source for this Project, the State, acting through
the State Controller, the State Treasurer or any other public agency, may withhold or demand a
transfer to the State of an equal amount from any future apportionments from any funding source
related to and/or utilized for transportation purposes due to County.
Futhermore, County understands and acknowledges its responsibilities and Project obligations,
including, but not limited to, obtaining Project access to property outside of State's right of way,
if necessary, issuing any necessary permits to construct on County property, and the future
financial obligation of the County to reimburse the State a third (33%) of all electric energy and
maintenance costs attributable to the presence of that Project. As such, State and County agree
that, notwithstanding Article 2, Section III of the Agreement, which maybe in conflict with this
expressed intent, the State may rely to its detriment upon these County's representations and
promises when executing the Agreement.
