HomeMy WebLinkAbout03-083~ '~~• s ~ ~ • ¢~~ '~~ ' ^ ~ R *: =* ,~• .y ~ .~ :' i BOARD 4F SUPE~t~I~~l~" CC)UNTY OF BUTTE, STATE OF CALIFaRNIA Resolution No. 03-083 A RESOLUTION AUTHORIZING THE SUBMITTAL OF THE REGIONAL FUNDING REQUEST FORM ON BEHALF OF THE COUNTY OF BUTTE, THE TOWN OF PARADISE, AND CITIES OF BIGGS & GRIDLEY, FOR FUNDING UNDER THE CALIFORNIA DEPARTMENT OF CONSERVATION BEVERAGE CONTAINER RECYCLING AND LITTER REDUCTION ACT WHEREAS, the people of the State of California have enacted the California Beverage Container Recycling and Litter Reduction Act that provides funds to Cities and Counties for beverage container recycling and litter cleanup activities; and WHEREAS, the California Department of Conservation's Division of Recycling has been delegated the responsibility for the administration of the program within the State, setting up necessary procedures for Cities and Counties or their designees under the program; and WHEREAS, the County of Butte recognizes that it is in the public interest to enact and implement an integrated waste management plan to address the State's diminishing landfill capacity and the potential adverse environmental impacts from landfilling; and WHEREAS, as part of its plan to conserve landfill capacity and address potential environmental impacts from landfilling, the Board of Supervisors of the County of Butte adopted the Source Reduction and Recycling Element and Household Hazardous Waste Element on November 10, 1992, which Elements are included in the Butte County Integrated Waste Management Plan; and WHEREAS, the County of Butte acknowledges that certain waste streams must be targeted to achieve the requirements of AB939 and to complete the implementation of selected recycling programs identified in the County's Source Reduction Recycling Element; and WHEREAS, the California Department of Conservation's Division of Recycling encourages and allows multiple jurisdictions to participate in regional grant programs which provide mutual benefits and consistency of programs for all participants within a region; and WHEREAS, the Town of Paradise, and the Cities of Biggs and Gridley, have authorized the County of Butte to act on their behalves by submitting a regional funding request form for funding under the California Department of Conservation's Beverage Container Recycling and Litter Reduction Act and to be the lead agency for the implementation of programs funded by said Act, and WHEREAS, per Public Resources Code, Section 14581 (a)(4)(E) of the California Beverage Container Recycling and Litter Reduction Act, the eligible participant must submit the Funding Request Form by the due date and time in order to request funds from the Department of Conservation's Division of Recycling. NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors authorizes joint participation, and the submittal of the Funding Request Form on behalf of the County of Butte, the Town of Paradise and the Cities of Biggs and Gridley, to the Department of Conservation's Division. of Recycling. The Director of Public Works of the County of Butte, or designee, is hereby authorized and empowered to execute in the name of the County of Butte and the Town of Paradise, the Cities of Biggs and Gridley all necessary forms and information hereto for the purposes of securing payment to implement and carry out the purposes specified in Public Resources Code, Section 14581 (a)(4)(A) of the California Beverage Container Recycling and Litter Reduction Act, and provide information regarding this program to the Division upon request. The County of Butte will be the responsible party to provide records to the Division should an audit be performed.
