RESOLUTION OF THE BUTTE COUNTY BOARD OF SUP~'S01i1f101T N0. 03-085
APPROVING THE APPLICATION FOR STATE OFF-HIGHWAY V H CLE GRANT
ENTITLED`BUTTE MEADOWS O&M" FOR SNOW REMOVAL
AND ASSOCIATED LAW ENFORCEMENT FOR RECREATIONAL PURPOSES
WHEREAS, people of the State of California have enacted the Off-Highway Motor Vehicle Recreation Act of 1988
which provides funds to the State of California and its political subdivisions for planning, acquiring, develo in
operating, conserving, and maintaining off-highway vehicle recreation; and

WHEREAS, the Off-Highway Motor Vehicle Recreation Division within the State of California Department of
Parks and Recreation has been delegated the responsibility to administer the program; and
WHEREAS, procedures established by the California Department of Parks and Recreation require the Ap ]icant to
certify by Resolution the approval of applications before submission to the State; and

WHEREAS, this project appears on or is in conformance with this jurisdiction's adopted general or master lan and
is compatible with the land use plans of those jurisdictions immediately surrounding this project.

NOW, THEREFORE, BE IT RESOL VED that the Butte County Board of Supervisors hereby:
1 • Approves the filing of an application for an Off-Highway Vehicle Grant;
2• Certifies that this agency understands its legal obligations to the State u on a
P pproval of the grant;
3• Certifies that this agency understands the California Public Resource Code requirement that
acquisition and development projects be maintained to specific conservations standards;
4• Certifies that the project will be well maintained during its useful life;
5• Certifies that this agency will implement the project with diligence once funds are available and a
Project Agreement has been consummated between the State and this agency;
~~ Certifies that this agency will provide the required matching funds (as applicable);
~• Certifies that the public and adjacent property owners have been notified of this project (as
applicable); and
8• Appoints the Butte County Sheriff as agent of the County of Butte to conduct all negotiations and
to execute and submit all required documents, including but not limited to, applications,
agreements, amendments, payment requests, etc., which may be necessary for the completion of
the project.
