RESOLUTION EXTENDING NON-EXCLUSIVE CABLE TELEVISION
FRANCHISES FOR THE UNINCORPORATED AREAS OF CHICO/DURHAM
AND THE UNINCORPORATED AREAS OF PARADISE
WHEREAS, pursuant to Butte County Resolutions 00-71 and 02-048, the COUNTY has
granted Comcast non-exclusive franchises to construct, operate and maintain a cable television
system (the "Franchise"); and
WHEREAS, AT&T Corp. filed a request with the COUNTY (prior to COMCAST's
ownership and control of cable television franchises in the Butte County area) to activate the
formal process for renewing the Franchises pursuant to the provisions of the Cable
Communications Policy Act of 1984 ("Cable Act")• and
WHEREAS, n egotiations c oncerning t he r enewal o f franchises w ere d elayed w ith t he
transfer of ownership and control of the cable television franchises from AT&T Corp. to
COMCAST; and
WHEREAS, C OMCAST r ecently a nnounced i is p lans t o u pgrade t he c able t elevision
system serving Butte County; and
WHEREAS, the parties are in discussions regarding the construction of a multi-fiber
system to interconnect various cities within the Butte County area; and
WHEREAS, t he p arties c ontinue n egotiations c oncerning a r enewal o f the F ranchises
utilizing the procedures set forth in the Cable Act.
NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors
hereby reauthorizes the following:
1) COUNTY has agreed to extend the cable television franchise of COMAST for the
unincorporated areas of Paradise (Resolution No. 02-048) through and including November
30, 2003; and
2) COUNTY has agreed to extend the cable television franchise of COMCAST for the
unincorporated areas of Chico/Durham (Resolution No. 00-71) through and including
November 30, 2003.
PASSED AND ADOPTED by the B utte County Board of Supervisors this 8t" day of
July 2003 by the following vote:
AYES: Supervisors Dolan, Houx, Josiassen, Yamaguchi and Chair Beeler
