RESOLUTION REGARDING BUTTE COUNTY DEPARTMENT OF BEHAVIORAL
HEALTH MENTAL HEALTH PLAN'S (MHP) OVERSIGHT COMMITTEE'S
ESTABLISHMENT OF COMPLIANCE PROGRAM
WHEREAS, Butte County Department of Behavioral Health Mental Health Plan
(MHP) is committed to maintaining a working environment that promotes ethical values,
exemplary behavior and compliance with the letter and spirit of all applicable laws. Such
an environment can exist only if MHP employees, physicians and agents demonstrate the
highest ethical standards in performing their daily task; and
WHEREAS, To achieve these objectives, the Butte County Board of Supervisors
of the MHP is directing management to proceed in the development and implementation
of a Compliance Program. The development and implementation of the Program is an
element in MHP's continuing effort to improve quality and performance. The Board
recognizes that state and federal agencies responsible for enforcement of Medicare and
Medicaid laws and regulations applicable to healthcare providers now require provider
organizations to develop and implement compliance programs, and the Compliance
Program will be designed to comply with that requirement.
NOW, THEREFORE, BE IT RESOLVED by the Butte County Board of Supervisors
that:
Management of MHP is directed to dedicate the necessary resources toward
development of an effective Compliance Program designed to prevent and
detect violations of federal or state law in the conduct of MHP operations by
employees, affiliated professionals and contractors.
2. The Compliance program will direct MHP to:
a. Establish compliance standards and procedures that promote
achievement of compliant business and clinical practices and reduce
the prospect of wrongful conduct;
b. Appoint a Compliance Officer and Compliance Committee who will
have overall responsibility to oversee compliance with such standards
and procedures;
c. Communicate effectively the compliance standards and procedures
to all employees and agents, including the provision of appropriate
education and training;
d. Create a reporting and disclosure system that allows employees and
agents to report perceived wrongful conduct by others within the
organization without fear or retribution;
e. Conduct routine and ad hoc audits to monitor compliance and assist
in the reduction of identified problems;
f. Consistently enforce its standards through appropriate disciplinary
mechanisms, including as appropriate, discipline of individuals for
failure to detect nan-compliance; and
g. Take responsible steps to respond appropriately to non-compliance
after detection and to prevent recurrence, which may require
modifications to the compliance program.
The development and implementation of specific standards, education and training
employees with respect to those specific standards, and reviewing and possible enhancing
internal controls and monitoring systems will be time-consuming. Management should
make steady progress toward the creation and implementation of specific standards and
systems relating to all material areas of MHP operations where there are compliance
obligations. Management shall provide periodic progress reports to the Butte County
Board of Supervisors.

of November 2003, by the following vote:
AYES: Supervisors Dolan, Houx, Yamaguchi and Chair Beeler

ABSENT: Supervisor Josiassen
