RESOLU'T'ION EXTENDING NON-EXCLUSIVE CAI3I,E TELEVISION
FRANCHISES FOR THE UNINCORPORATED AREAS OF CHICOIDURHANI
AND `I >EIE UNINCORPORATED AREAS OF PARADISE
WHEREAS, pursuant to Butte County Resolutions 00-71 and 02-048, the COUNTY has
granted Comcast non-exclusive franchises to construct, operate and maintain a cable television
system (the "Franchise"); and
WHEREAS, AT&T Corp. filed a request with the COUNTY (prior to COMCAST's
ownership and control of cable television franchises in the Butte County area) to activate the
formal process for renewing the Franchises pursuant to the provisions of the Cable
Communications Policy Act of 1)84 ("Cable Act"); and
WHEREAS, negotiations concerning the renewal of franchises were delayed with the
transfer of ownership and control of the cable television franchises from AT&T Corp. to
COMCAST; and
WHEREAS, COMCAST recently announced its plans to upgrade the cable television
system serving Butte County; and
WHEREAS, the parties are in discussions regarding the construction of a multi-fiber
system to interconnect various cities within the Butte County area; and
WHEREAS, the parties continue negotiations concerning a renewal of the Franchises
utilizing the procedures set forth in the Cable Act; and
WHEREAS, pursuant to Butte County Resolution 03-110, the COUNTY has agreed to
extend the cable television franchise of COMAST for the unincorporated areas of Paradise
(Resolution No. 02-048) and the unincorporated areas of Chico/Durham (Resolution No. 00-71)
through and including November 30, 2003; and
WHEREAS, pursuant to Butte County Resolution 03-165, the COUNTY has agreed to
extend the cable television franchise of COMAST for the unincorporated areas of Paradise
(Resolution No. 02-048) and the unincorporated areas of Chico/Durham (Resolution No. 00-71)
through and including December 31, 2003.
NOVV, THEREP'ORG, BE IT RESOLVED that the Butte County Board of Supervisors
hereby reauthorizes the following:
1} COUNTY has agreed to extend the cable television franchise of COMAST for the
unineo~porated areas of Paradise (Resolution No. 42-048) and the unincorporated areas of
ChicoJDurham (Resolution No. 00-71) through and including January 31, 2004.
PASSED AND ADOP'T'ED by the Butte County Board of Supervisors this 16`" day of
December 2003 by the following vote:
AYES: Supervisors Dolan, Houx, Josiassen, Yamaguchi and Chair Beeler
NOES: None
ABSENT: None
NOT VOTING: None
