HomeMy WebLinkAbout04-006 (2)+;.1~ ik~ .~ ` GOUN7"Y ~~ BU`1'T~, STATE ~.~~~DF~ Resolution No. 04-006 RESOLUTION ABANDONING A PUBLIC UTILITY EASEMENT (A PUBLIC UTILITY EASEMENT IN LOT 159, PARADISE PINES, UNIT 3 SUBDIVISION) WHEREAS, this matter came on regularly for hearing before the Board of Supervisors of the County of Butte, State of California, on December 2, 2003, in the Board Chambers, Butte County Administration Building, 25 County Center Drive, Oroville, California; and WHEREAS, it appearing to said Board that notice of the time and place of the hearing on the petition for the abandonment of the public utility easement in question was duly and regularly given as required by law; and, WHEREAS, testimony and evidence, both oral and documentary, having been produced at said hearing, from which said Board now finds that: (1) there is no possibility the proposed abandonment of this public utility easement may have a significant effect on the environment, and it is therefore not subject to the California Environmental Quality Act; (2) the proposed abandonment is in conformance with the Butte County General Plan; and (3) the public utility easement in question, as hereinafter described, is unnecessary for present or prospective public use. NOW, THEREFORE, IT IS HEREBY ORDERED as follows: L That the public utility easement situated in the Cowlty of Butte, State of California, as hereinafter more particularly described, is hereby abandoned pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code, commencing with Section 8320. 2. That said public utility easement so abandoned is located in the unincorporated area of the County of Butte, State of California, in the Chico area, in the Paradise Pines, Unit 3, identified as a portion of Assessor's Parcel Number 065-400-015, and is described as follows: That certain 10 foot wide Public Utility Easement affecting Lot 159 as shown on that certain map entitled "Paradise Pines Unit No.3" ,filed with the Recorder of Butte County, California on June 17, 1970 in Book 35 of Maps, at Pages 78, 79, 80, 81 and 82, more particularly described as follows: A 10 foot wide strip of land lying 10 feet southerly of, parallel with and adjacent to the Northerly Boundary of said Lot 159 and lying westerly of the 10 foot Public Utility Easement that is 10 feet westerly of, parallel with and adjacent to the easterly boundary of said Lot 159 and the end of the herein described easement. 3. That a snap showing the Public Utility Easement hereby abandoned is on file in the Office of the Butte County Department of Public Works, 7 County Center Drive, Oroville, California 95965. 4. That the Clerk of this Board shall cause a certified copy of this Resolution, with the seal of the Board of Supervisors of the County of Butte, State of California, to be recorded in the Office of the Recorder of the County of Butte, State of California.
