HomeMy WebLinkAbout04-052,. ~~r~~ o~ ~u~-~~v~~a~5 COUNTY OF BUTTE, STATE Of C/4LIFORNI A I2esol~tion N~. o4-o~z RESOLUTION DECLARING UNCLAIMED MONIES, IN THE COUNTY TREASURY, PROPERTY OF THE COUNTY OF BUTTE AND TRANSFERRING SAID UNCLAIMED MONIES TO THE COUNTY GENERAL FUND RESOLVED, by the Board of Supervisors of the County of Butte, State of California, that WHEREAS, there is currently on deposit with the County Treasurer of the County of Butte in a fund entitled, "Treasurer CPC 7663 (b)", the sum of $54,710.64, which has remained unclaimed in the County Treasury, of the County of Butte, for more than three years and which sums were received from the Public Administrator's Office; and WHEREAS, the County Treasurer has caused appropriate notice to be published in the form and manner provided by Government Code Section 50050 and 50051 in the Enterprise Record, a newspaper of general circulation published in the County of Butte, as appears from the affidavit of publication on file with the Clerk of this Board as set forth in Exhibit "A" attached hereto; and WHEREAS, after due diligence there remains $31,774.96 in said fund after claims were made on said monies, it is necessary and desirable to provide for the escheatment of said monies to the County of Butte pursuant to Government Code 50050 et seq.; and WHEREAS, the unclaimed monies in the amount of $31,774.96, have become the property of the County of Butte, and this Board of Supervisors desires to transfer said monies from the special fund in which it has been deposited to the County Treasurer, to the General Fund of the County; NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED; (1) That the remaining unclaimed monies totaling $31,744.96 on deposit with the County Treasurer of the County of Butte described in Exhibit "A", attached hereto, shall be and hereby are declared to be the property of the Caunty of Butte; (2) That the unclaimed funds totaling $31,774.96 shall be transferred into the General Fund of the County as unanticipated revenue; (3) That the Clerk of this Board is hereby authorized and directed to send a certified copy of this Resolution to the County Treasurer and County Auditor. NOTICE IS FURTHER GIVEN pursuant to said Government Code Sections that it is proposed that said money v~~ill become the property of the County Butte an March 1, 2004, unless a claimant ar claimants files a claim with the treasurer which includes the claimant's name, address, amount of claim and the grounds on which the claim is founded on or before March Z, 2004. If the claim is rejected by the treasurer, the claimant may file a verified complaint seeking to recover, all, or a designated part, of the money in a court of competent jurisdiction within Butte County, and serves a copy of the complaint and the summons issued thereon upon the County Treasurer within 30 days of receiving notice of rejection.
