HomeMy WebLinkAbout04-057BOARD aF ~UPERVI~+~RS COUNTY OF BUTTE, STATE C7F CALIFORNIA Rc~solufion No. 04-05~ RESOLUTION AUTHORIZING THE CREATION OF THE COUNTY OF BUTTE INDIAN GAMING LOCAL COMMUNITY BENEFIT COMMITTEE WHEREAS, on October 11, 2003, the Governor approved Senate Bill 621 which established a method for distributing funds from the Indian Gaming Special Distribution Fund to local government agencies impacted by tribal gaming; and WHEREAS, in accordance with SB 621, codified in part through Government Code Sections 12710-12718, an Individual Tribal Casino Account has been established by the State Controller for each casino paying into the Special Distribution Fund; and WHEREAS, Senate Bill 621 requires the creation of a seven (7) member Indian Gaming Local Community Benefit Committee (the Committee) in every County where tribal gaming is conducted; and WHEREAS, the Committee is comprised of the following representatives: Two representatives of the County selected by the Board of Supervisors, three elected representatives fi•om cities located within 4 miles of a tribal casino in the County, selected by the County Board of Supervisors, and two representatives selected upon the recommendation of a majority of the tribes paying into the Indian Gaming Special Distribution Fund; and WHEREAS, local government agencies impacted by the t~7bal casinos may make application to the Committee for grant funding from Individual Tribal Casino Accounts upon the affirmative sponsorship of the tribe paying into the Indian Gaming Special Distribution Fund; and WHEREAS, the Committee has the following responsibilities: a. Establish all application policies and procedures for grants; b. Assess the eligibility of applications for grants from local jurisdictions impacted by tribal gaming operations; c. Determine the appropriate amount for reimbursement of the demonstration costs incurred by the County for administering the grant programs; and WHEREAS, the terms of office of the members shall be four (4) years expiring on June 30 of the appropriate years and subsequent new terms shall begin July 1 of that year. The first term of office shall be deemed to commence on July 1, 2004, only for purposes of subsequent appointment of members. Of the initial term committee members, three shall serve a term of three years, and four shall serve a term of four years. Thereafter, each term of office shall be four years. The identification of which members shall be three years and which shall be four years shall be determined by lot drawn by the County of Butte Administrative Office staff. NOW, THEKEFORE, BE IT RESOLVED, that the Board of Supervisors of the County of Butte hereby establishes the County of Butte Indian Gaming Local Community Benefit Committee.
