HomeMy WebLinkAbout04-078RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE PROVIDING FOR BOARD APPROVAL AND RECORDA"PION OF CERTIFICATE OF WILLIAMSON ACT EXPIRATIONS FOR INDIVIDUAL WILLIAMSON ACT CONTRACTS AT TIME OF CONTRACT TERMINATION PURSUANT TO A NOTICE OF NON-RENEWAL WHEREAS, the Williamson Act provides for the ternlination of Williamson Act Cantracts through a Notice of Non-Renewal pursuant to Government Code Section 51245 on private lands under Williamson Act Contracts within the County of Butte; and WHEREAS, such Notice ofNon-Renewals are required bylaw to be provided by the landowner to the County 90 days prior to the contracts anniversary (renewal) date if the praperty owner wishes to Non-Renew their Williamson Act Contract; and WHEREAS, the effective date of Non-Renewal is nine-years from the contracts anniversary date on the last day of the year, December 31; and, WHEREAS, Notices ofNon-Renewal are required to be recorded with the County Recorder in~der Government Code Section 51245; and, WHEREAS, the County is required to send a Notice of Expiration to the Department of Conservation under Government Code Section 51246 (a); and WHEREAS, Government Code Section 5 ~I 246 (a) is silent on whether the Notice of Expiration may be recorded; and, WHEREAS, officials at the Department of Conservation have been consulted on this matter and indicated that it is beneficial to record Notices of Expiration; and, WHEREAS, a means of tracking contracts that have expired after being Non- Renewed is necessary to provide an accurate record for the County and landowner; NO~V, THEREFORE, BE IT RESOLVED, that the Board of Supervisors delegates to the Department of Development Services the authority to complete Certificate of Williamson Aet Expirations for contracts that have expired pursuant to Government Code Section 51245 NO~~, THEREFORE, BE IT FURTHER RESOLVED, that the Department of Development Services shall provide for approval of said Certificate of Expirations upon the Board of Supervisor's Consent Agenda, and that said Expirations shall be recorded tvith the County Clerk Recorder after approval by the Board of Supervisors. PASSED AND ADOPTED by the Board of Supervisors ofthe County of Butte, State of California, on this 11th day of May , 2004, by the following vote: AYES: Supervisors Dolan, Houx, Josiassen, Yamaguchi and Chair Beeler NOES: None ABSENT: None NOT VOTING: None R.
