RESOLUTION RECOGNIZING AND REINFORCING PRINCIPLES OF PUBLIC
ACCOUNTABILITY IN PAYMENT OF COMPENSATION TO COUNTY EMPLOYEES
WHEREAS, County operations are funded by taxpayers; and
WHEREAS, Article XVI, Sec. 6, of the California Constitution prohibits
the County from making a gift of public funds; and
WHEREAS, the public expects a high degree of accountability for the
expenditure of public funds; and
WHEREAS, such accountability includes the principle that public
employees should not be paid for time not worked; and
WHEREAS, such accountability is particularly important in the current
climate of severe fiscal constraints; and
WHEREAS, the Fair Labor Standards Act and the regulations and court
decisions interpreting the Act place restrictions on an employer's ability to
adjust the compensation of exempt employees for time not actually worked; and
WHEREAS, the United States Department of Labor has recognized that
application of the Fair Labor Standards Act to public entities is sometimes
in conflict with state and local statutes prohibiting public employees from
being paid for time not actually worked; and
WHEREAS, in recognition of this conflict the Department of Labor has
promulgated regulations that allow public entities to adjust employees'

salaries for hours not worked pursuant to principles of public
accountability;
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors
recognizes and reinforces the principles of public accountability in
payment of compensation of its employees.
PASSED AND ADOPTED by the Board of Supervisors of the County of
Butte, State of California, on the 22nd day of June 2004 by the
following votes:
AYES: Supervisors Dolan, Houx, Josiassen, Yamaguchi and Chair Beeler
