BOARD OF SUPERVIaO~S COUNTY OF BUTTE, STATE OF CALIFORNIA Resolution X10. 04- 107 RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE [NCREASING PARK FACILITY FEES IN THE DURHAM RECREATION AND PARK DISTRICT WHEREAS, the Board of Supervisors of the County of Butte, by Ordinance Number 3081, adopted on July 27, 1993, added Article V to Chapter 16 of the Butte County Code authorizing the assessment and levying of Park Facility Fees on any owner of real property located in the unincorporated area of the Durham Recreation and Park District adding residential dwelling units to such property, in order to fund the cost of the additional park facilities which will be necessary in order to meet the recreational needs of the new residents resulting from such developments; and WHEREAS, the Board of Supervisors, by this Resolution, desires to: amend the amount of said Park Facility Fee in the manner provided for in said Article V of Chapter 16 of the Butte County Code; demonstrate that such fee complies with all of the factors enumerated in Section 16-46 of said Article and Chapter of the Butte County Code; and, by reason thereof, confirm that such Park Facility Fee meets each of the "nexus" requirements set forth in Section 66001 of the California Government Code, all for the reasons set out in Section 16-41 of said Article and Chapter of the Butte County Code; and, WHEREAS, the Board of Supervisors has considered this Resolution at a public hearing, notice of which was given in the manner provided for by Sections 66004, 66016, 66017(a) and 66018 of the California Government Code; and, WHEREAS, the Board of Supervisors has determined the amount of the increase in the Park Facility Fee using the June 2004 "Building Cost Index History" as published in the Engineering News Record.. NOW, TH EREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte as follows: The Board of Supervisors adopts the Park Facility Fee of $1.41 per square foot as set forth in Exhibit "A,"a letter dated May 25, 2004 from the Durham Recreation & Park District to the Butte County Board of Supervisors, and Exhibit "B," the "Building Cost Index History" including the June 2004 index amount and the calculation using that amount to determine the current fee, attached hereto and by this reference incorporated herein. 2. The Board of Supervisors finds that the Park Facility Fee adopted by this Resolution complies with the requirements of Section 16-46 of the Butte County Code, entitled "Annual Adjustment to Park Facility Fees." 3. The Board of Supervisors confirms that since said Park Facility Fee adopted by this Resolution complies with the requirements of Section 16-46 of the Butte County Code, such fees also meet each of the "nexus" requirements set forth in Section 66001 of the California Government Code, all for the reasons set out in Section 16-41 of the Butte County Code, entitled "Findings." 4. [n accordance with the provisions of Section 66017 of the California Government Code, this Resolution as well as the Park Facility Fee provided for herein, shall not become effective until the 61st day following its adoption. To that end, please co~lsider the following information, to familiarize you with the Durham Recreation and Park District, it's current situation and it's future goals. The Durham Recreation and Parl< District began with the establishment of the Durham Community Park. This park has served as a social gathering place since the inception of the community. The twenty-four acre park was specifically set aside when land allocations were established for the area in 1918. The District gained responsibility for the park in 1947. The district has grown significantly in the last len years to a population of 5,063 persons according to the current census. The purpose of the park facility fee is to collect fiords for the acquisition and development of new parklands within the Durham Recreation and Park District. The park facility fee is imposed on new residential development within the district. The Curds are to be expended on capital improvements necessary to meet the recreational needs of new residents. The fee is imposed on each square foot of assessable space in new residential development within the district. The fee is applicable to residential development of 500 square feet or greater, excluding any carport, walkway, garage, overhang, patio, enclosed patio, detached accessory structure, or similar area. The actual square footage is calculated by the Building Division of the Development Services Department of the cowity. The current fee of ~ 1.07 per square foot is no longer adequate. This fee was based on the projected recreational needs of new residents over afive-year period, beginning in 1993. The district has chosen not to request an increase in the fee for the last ten years. Exhibit A May 25, 2004 Butte County Board of Supervisors Page 2 The District's Master Plan calls for a Neighborhood Park in the area near Butte College. Current land values have increased significantly in this area. In 1993, land value for the Clark Road area was $10,000.00 per acre. Today's figure from the Butte County Assessor's office is $20,000.00 per acre. Current cost per acre for development of a Neighborhood Park ranges from $130,381.00 to $164,550.00 (please see attached Nexus studies for CARD and Feather River Recreation and Park District). An average of these two figures is $147,465.00. A Neighborhood Park ranges from two to four acres. Thus, for afoot-acre park, costs would be $80,000.00 for acquisition and $589,860.00 for development, for a total cost of $669,860.00. At the c~u-rent estimated $60,000.00 of park facility fees collected per year, it would take eleven years to accumulate the necessary funds. County ordinance 3081, adopted July 27, 1993, states that the Board of Supervisors may increase these fees on July 1 ~` of any year based on information substantiating that there has been an increase in the cost of acquiring and/or developing park facilities within the district, using the net percentage increase in the Engineering News Record, cost index for San Francisco (based on 1913 U.S. average = 100). Using the "building cost index history," the factor that would have been used in July of 1993 was 3038. The factor for April of 2004 is 3908. If you divide 3038 into 3908 the resulting factor is 1.286. Multiplying the 1.286 factor by the current $1.07 per sq. ft. would result in a new figure of $1.38 per sq. ft. Of co~u-se, the Board may deem it appropriate to utilize the June 2004 figure when it is published in lieu of the April 2004 factor.
