RESOLUTION EXCHANGING OFFER OF RIGHT-OF-WAY DEDICATION
V-2 ROAD EXTENSION CROSSING LOT 1, "COPRA SUBDIVISION,"
BOOK SS MAPS PAGES 70 & 71
WHEREAS, the County previously approved the relocation for the V-2 Road extension
through Lot l of the Copra Subdivision by Board Resolution No. 96-133; and
WHEREAS, said Resolution was recorded in Butte County Official Records on December
12, 1996 at Serial Number 1996-046814; and
WHEREAS, said Resolution No. 96-133 established an offer of dedication fora non-
exclusive easement for a public street, public utilities and drainage over a strip. of land 60 feet in
width as described in attached Exhibit "A"; and
WHEREAS, the affected property owner wishes to relocate a portion of said easement to a
mutually agreed upon location and to make an offer of dedication in fee for the new location to the
County of Butte as described in Exhibit "B"; and
WHEREAS, upon said relocation, a portion of the dedication accepted byResolution No. 96-
133 will not be necessary for public or County use; and
WHEREAS, the new offer of dedication, as described in Exhibit "C" attached hereto, maybe
necessary for t11e public or County use at a future time; and
WHEREAS, that portion not necessary for public use is described in Exhibit "D" attached
hereto; and
WHEREAS, the said offers of dedication to be exchanged are of equal value; and
WHEREAS, said exchange and the terniination and abandonment of that portion of the offer
of dedication as described in attached Exhibit "D" will not cut off any access to any person's
property which, prior to relocation, adjoined said easement and, will not terminate any public service
easement.
WHEREAS, the Palermo Union School District, a public entity, wishes to acquire a portion
of Lot 1 of the Copra Subdivision, as described in attached Exhibit "E" (lying on both sides of the
new offer of dedication to the County of Butte described in attached Exhibit "C"), for purposes of
obtaining a grant for the construction of a public street to be accepted by the County of Butte on
property described in Exhibit "C"; and
WHEREAS, pursuant to the provisions of the Subdivision Map Act (Government Code)
Section 66428 (a) (2), the Board of Supervisors finds that public policy does not necessitate the filing
of a Parcel Map for the Palermo Union School District to acquire the property as described in
attached Exhibit "E"; and
WHEREAS, the County of Butte would formally accept the offer of dedication described in
Exhibit "C" after such property was improved with a road with curb, gutter, sidewalk, and
appropriate storm drainage facilities, constructed to County Standards in accordance with approved
plans.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of
Butte as follows:
1. That portion of the offer of dedication adopted by Resolution No. 96-133 as described in
Summary Abandonment and Right of Way Exchange Page 2 of 3
attached Exhibit "D" is term i Hated and abandoned pursuant to Government Code Section 66477.2(c)
and Streets and Highways Code Section 8330, and is exchanged for the offer of dedication described
in Exhibit "C" attached hereto.
2. Said termination and abandonment and exchange shall be effected upon recordation of
this resolution.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 13`h day of
July, 2004 by the following vote:
AYES: Supervisors Dolan, Houx, Josiassen, Yamaguchi and Chair Beeler

Anon-exclusive easement for a public street, public utilities and drainage, over a strip of land 60.00
feet in width, lying 30.00 feet on both sides of the herein described centerline together with certain
radiused returns located along the sidelines of said easement, said easement crossing a portion
of Lot 4, Block 11 according to that certain map entitled "Villa Verona, Butte County, Calif.", as filed
for record on January 17, 1889 in the Office of the Recorder as Wall Map #2, said easement also
crossing a portion of Lot 1 of that certain map entitled "Copra Subdivision", as filed for record on
August 5, 1982 in Book 85, Maps at Pages 70 and 71, all lying in the southwest quarter of Section

Commencing at the intersection of the centerline of Via Laton with the centerline of Autrey Lane,

00° 10'01" W, along the centerline of Autrey Lane, 124.64 feet, to a point on the southerly boundary
