RESOLUTION 04-130
RESOLUTION MAKING THE PROVISIONS OF THE CALIFORNIA EDUCATION
CODE RELATING TO SCHOOL FACILITIES IMPROVEMENT DISTRICTS
APPLICABLE TO BUTTE COUNTY
WHEREAS, Chapter 3 (commencing with section 15300) of Part 10 of Division 1 of Title 1 of the
California Education Code (the "Law") authorizes school districts to form school facilities improvement
districts consisting of a portion of the territory within the school district and permits the issuance of general
obligation bonds by a school facilities improvement district with approving vote of at least two-thirds (and
in some cases 55%) of the votes cast in the improvement district;
WHEREAS, the Law does not allow a school district to proceed with formation of a school
facilities improvement district until the board of supervisors for the county or counties in which the
proposed school facilities improvement district lies, by resolution adopted by a majority vote of each such
board of supervisors, makes the Law applicable in their respective counties; and
WHEREAS, the Gridley Unified School District (the "District") has requested that the Board adopt
a resolution making the Law applicable in the County of Butte;
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors hereby makes the Law
applicable in the County so that school districts in the County may form school facilities improvement
districts and issue general obligation bonds to finance school facilities.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 13`h day of July, 2004
by the following vote:
AYES: Supervisors llolan, Houx, Josiassen, Yamaguchi and Chair Beeler
