RESOLUTION OF THE BOARD OF SUPERVISORS
OF THE COUNTY OF Bt1TTE
NOTICING THEIR INTENT TO ADOPT A GROUNDWATER
MANAGEMENT PC.AN UNDER WATER CODE §10750 etsey. (AB 3030, STATS
1992) FOR THE AREAS OF BUTTE COUNTY NOT COVERED BY ANOTHER
GROUNDWATER MANAGEMENT PLAN UNDER THIS AUTHORITY OR
ANY OTHER AUTHORITY
W II EREAS, the Legislature finds and declares that groundwater is a valuable
natural resource in California and should be managed to ensure both its safe production
and its duality; and
WHEREAS, it is the intent of the [~egislature through the passage of AB3030
(Stats 1992) codified as Water Code §10750 et sE~y. to encourage local agencies to work
cooperatively to manage groundwater resources within their jurisdictions; and
WHEREAS, the Legislature also finds and declares that the additional study of
groundwater resources is necessary to better understand how to manage groundwater
effectively to ensure the safe production, quality, and proper storage on groundwater in
this state; and
WHEREAS, the adoption of a Groundwater Management Plan is encouraged, but
not required by law; and
WHEREAS, any local agency, whose service area includes a groundwater basin,
or a portion of a groundwater basin, that is not subject to groundwater management
pursuant to other provisions of law or a court order, judgment, or decree, may, by
ordinance, or by resolution if the local agency is not authorized to act by ordinance, adopt
and implement a groundwater management plan pursuant to this part within all or a
portion of its service area not served by a local agency or served by a local agency whose
governing body, by a majority vote, declines to exercise the authority to implement a
groundwater management plan and enters into an agreement with the local public agency
pursuant to Water Code ~ 10750.7 and fi10750.~; and
WHEREAS, the County of E3utte is interested in the development of a
Groundwater Management Plan as defined under Water Code Section 10750, ~,~t sc~y. for
the areas of the County not covered by another groundwater management plan; and
WHEREAS. prior to adopting a resolution of intention to adopt a groundwater
management plan, Water Code ~ l 0753.5 requires a local agency to hold a second
hearing, after publication of notice pursuant to Government Code §6066, on whether or
not to adopt a resolution of intention to adopt a Groundwater Management Plan, and take
protests, pursuant to this part for the purposes of implementing the plan and establishing
a groundwater management program; and
WHEREAS, a resolution of intention to draft a groundwater management plan
was passed on August 23, 2003, and such hearing was noticed pursuant to Government
Code §6066; and
WHEREAS, a resolution to schedule a hearing to adopt a groundwater
management plan was recommended by the Water Commission on August 3, 2004.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of the
County of Butte hereby agree to:
i . Adapt a Resolution to schedule a hearing far adopting a Groundwater
Management Plan pursuant to Water Code § 10750 et s~rj. for the purposes of
hearing protests and adopting the plan and establishing a groundwater
management program at 10:30 am on September 28, 2004.
2. Direct the Clerk of the Board to publish natice as required under Government
Code X6066 pursuant to Water Code ~ 10753.5.
3. Direct the Department of Water and Resource Conservation to document
suggested changes to the groundwater management plan, based on comments
received on the public review draft, under Water Code § 10750 et sey.

day of August 2004 by the following vote:
