PUBLIC RIGHTS OF WAY
16T" STREET, l8T" STREET AND FEATHER AVENUE
WHEREAS, This matter came on regularly for hearing before the Board of Supervisors
of the County of Butte, State of California, on August 31, 2004, in the Board Chambers, Butte
County Administration Building, 25 County Center Drive, Oroville, California; and,
WHEREAS, it appearing to said Board that notice of the time and place of the hearing
on the petition for the abandonment of the public rights of way in question was duly and
regularly given as required by law; and
WHEREAS, testimony and evidence, both oral and documentary, having been produced
at said hearing, from which said Board now finds that: (1) there is no possibility the proposed
abandonment of these public rights of way may have a significant effect on the environment, and
it is therefore not subject to the California Environmental Act; (2) the proposed abandonment is
in conformance with the Butte County General Plan; and (3) the public rights of way in question,
as hereinafter described are unnecessary for present or prospective public use.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors:
1. That the public rights of way situated in the County of Butte, State of California,
as hereinafter more particularly described, are hereby abandoned pursuant to Chapter 3 of Part 3
of Division 9 of the California Streets and Highways code (commencing with Section 8320).
2. That said public rights of way so abandoned are located in the unincorporated
area of the County of Butte, State of California, are identified as 16`" Street, 18`h Street and
Feather Avenue and are more particularly described as follows:
ALL THAT REAL PROPERTY DESCRIBED AS A PORTION OF 16TH STREET, A
PORTION OF 18TH STREET, AND A PORTION OF FEATHER AVENUE,
ACCORDING TO THAT CERTAIN MAP ENTITLED "THERMALITO" AS FILED
FOR RECORD IN THE OFFICE OF THE COUNTY RECORDER AS WALL MAP
NUMBER 6, LYING IN SECTION 14, TOWNSH[P 19 NORTH, RANGE 3 EAST,
M.D.M., BUTTE COUNTY, CALIFORNIA, BEING MORE PARTICULARLY
DESCRIBED AS FOLLOWS:
16TH STREET
A STRIP OF LAND, HAVING A WIDTH AS DEFINED HEREIN, BEING A
PORTION OF BLOCK 112 AND BLOCK 103, ACCORDING TO SAID MAP OF
THERMALITO, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE INTERSECTION OF THE CENTERLINE OF 16TH
STREET WITH THE CENTERLINE OF FEATHER AVENUE; THENCE S 00°11'41"
E, ALONG THE CENTERLINE OF 16TH STREET, 40.00 FEET, TO THE TRUE
POINT OF BEGINNING FOR THE HEREIN DESCRIBED STRIP OF LAND, SAID
STRIP BEING 60.00 FEET IN WIDTH, LYING 30.00 FEET ON BOTH SIDES OF
THE DESCRIBED LINE; THENCE CONTINUING S 00°11'41" E ALONG SAID
CENTERLINE, 354.92 FEET, TO AN ANGLE POINT IN THE EASTERLY
BOUNDARY OF PARCEL ONE, ACCORDING TO THAT CERTAIN PARCEL MAP
AS FILED FOR RECORD IN BOOK 82, MAPS AT PAGE 13; THENCE S 00° 11'41 "
E, CONTINUING ALONG SAID CENTERLINE, THE DESCRIBED STRIP HERE
BEING 30.00 FEET IN WIDTH AND LYING TOTALLY ON THE WEST SIDE OF
THE DESCRIBED LINE, 395.50 FEET, TO THE SOUTHEAST CORNER OF SAID
PARCEL ONE AND THE END OF THE DESCRIBE LINE.
RESERVING THEREFROM AN EASEMENT FOR PUBLIC UTILITY PURPOSES,
OVER A STRIP OF LAND, HAVING A WIDTH AS DEFINED HEREIN, BEING A
PORTION OF BLOCK 112 AND BLOCK 103, ACCORDING TO SAID MAP OF
THERMALITO, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

E, CONTINUING ALONG SAID CENTERLINE, THE DESCRIBED STRIP HERE
BEING 15.00 FEET IN WIDTH AND LYING TOTALLY ON THE WEST SIDE OF
THE DESCRIBED LINE, 395.50 FEET, TO THE SOUTHEAST CORNER OF SAID
PARCEL ONE AND THE END OF THE DESCRIBE LINE.

AS SHOWN ON THAT CERTAIN MAP ENTITLED "CALLE VISTA ESTATES,
UNIT #1" AS FILED FOR RECORD IN BOOK 126, MAPS AT PAGE 82:
BOUNDED ON THE SOUTH BY THE WESTERLY PROJECTION OF THE SOUTH
LINE OF PARCEL 1, ACCORDING TO THAT CERTAIN PARCEL MAP AS FILED
FOR RECORD IN BOOK 82, MAPS AT PAGE 13:
BOUNDED ON THE NORTH BY AN ARC CONCAVE SOUTHEASTERLY,
HAVING A RADIUS OF 20.00 FEET. THE WESTERLY TANGENT THERETO
BEING A LINE LYING 35.50 FEET EASTERLY OF AND PARALLEL WITH THE

RESERVING THEREFROM AN EASEMENT FOR PUBLIC UTILITIES OVER
THAT PORTION OF 18TH STREET, LYING WESTERLY OF AND ADJACENT TO
THE WEST LINE OF THAT CERTAIN THERMALITO IRRIGATION DISTRICT
WELL EASEMENT AS DESCRIBED IN DEED AS FILED FOR RECORD IN BOOK

ALL THAT PORTION OF FEATHER AVENUE, ACCORDING TO SAID MAP OF
THERMALITO LYING SOUTHERLY OF A LINE LYING 30.000 FEET
SOUTHERLY OF AND PARALLEL WITH THE CENTERLINE OF FEATHER
AVENUE:
BOUNDED ON THE EAST BY THE NORTHERLY PROJECTION OF THE EAST
LINE OF PARCEL 1, ACCORDING TO THAT CERTAIN PARCEL MAP AS FILED
FOR RECORD IN BOOK 82, MAPS AT PAGE 13:
BOUNDED ON THE WEST BY AN ARC CONCAVE SOUTHEASTERLY, HAVING
A RADIUS OF 20.00 FEET, THE WESTERLY TANGENT THERETO BEING A LINE
LYING 35.50 FEET EASTERLY OF AND PARALLEL WITH THE BUTTE COUNTY

RESERVING THEREFROM AN EASEMENT FOR PUBLIC UTILITIES OVER
THAT PORTION OF FEATHER AVENUE, LYING NORTHERLY OF AND
ADJACENT TO THE NORTH LINE OF THAT CERTAIN THERMALITO
IRRIGATION DISTRICT WELL EASEMENT AS DESCRIBED IN DEED AS FILED
FOR RECORD IN BOOK 364, OFFICIAL RECORDS AT PAGE 173.
ALSO RESERVING THEREFROM AN EASEMENT FOR PUBLIC UTILITIES
OVER THAT PORTION OF THE ABOVE DESCRIBED LANDS LYING
NORTHERLY OF AND ADJACENT TO THE FOLLOWING DESCRIBED LINE:
COMMENCING AT THE NORTHEAST CORNER OF PARCEL 2, ACCORDING TO
THAT CERTAIN PARCEL MAP AS FILED FOR RECORD IN BOOK 82, MAPS AT
PAGE 13, SAID CORNER BEING LOCATED 30.00 FEET FROM THE
CENTERLINE OF 16TH STREET; THENCE N 89°49'24" E, ALONG THE NORTH
LINE OF SAID BLOCK 112, 30.00 FEET, TO A POINT ON THE CENTERLINE OF
16TH STREET; THENCE N 89°49'17" E, ALONG THE NORTH LINE OF BLOCK
103,405.52 FEET, TO THE NORTHEAST CORNER OF PARCEL 1, ACCORDING
TO SAID PARCEL MAP, AND THE END OF THE DESCRIBED LINE.
3. That a map showing the rights of way hereby abandoned is on file in the Office of
the Butte County Department of Public Works, 7 County Center Drive, Oroville, California
95965.

4. That the clerk of this Board shall cause a certified copy of this Resolution, with
the sea] of the Board of supervisors of the County of Butte, State of California, to be recorded in
the Office of the Recorder of the County of Butte, State of California.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 315` day of
August, 2004, by the following vote:
