RESOLUTION OF THE BOARD OF S[1PERVISORS
OF THE COUNTY OF BUTTE
TO ADOPT A GROUNDWATER MANAGEMENT PLAN UNDER AB
3030 (WATER CODE §l0'750 et secy. (, STA'I'S 1992) FOR THE AREAS OF
BUTTE COUNTY NOT MANAGED BY ANOTHER ENTITY
WHEREAS, the Legislature has found and declared that groundwater is a
valuable natural resource in California and should be managed to ensure both its safe
production and its quality; and
WHEREAS, it was the intent of the Legislature through the passage of A83030
(Stats 1992) codified as Water Code X10750 ~1 se y. to encourage local agencies to work
cooperatively to manage groundwater resources within their jurisdictions; and
WHEREAS, the Legislature has also found and declared that the additional study
of groundwater resources is necessary to better understand how to manage groundwater
effectively to ensure the safe production, quality, and proper storage on groundwater in
this state; and
WHEREAS, the adoption of a Groundwater Management Plan is encouraged, but
not required by law; and
WHEREAS, any local agency, whose service area includes a groundwater basin,
or a portion of a groundwater basin, that is not subject to groundwater management
pursuant to other provisions of law or a court order, judgment, or decree, may, by
ordinance adopt and implement a groundwater management plan pursuant to this part
within all or a portion of its service area not served by another local agency; and
WHEREAS, the County of Butte is interested in the development of a
<iraundwater Management Plan as defined under Water Code Section 10750, et .ti~ecf. for
the areas of the County not covered by another groundwater management plan; and
WHEREAS, prior to adopting a resolution of intention to draft a groundwater
management plan, Water Code ~10753~2 requires a local agency to hold a second
hearing, after publication of notice, on whether or not to adopt a resolution of intention to
draft a Groundwater Management Plan, and take protests, pursuant to this part for the
purposes of implementing the plan and establishing a groundwater management program;
and
WHEREAS, the Board of Supervisors adopted a resolution of intent (Resolution
No. 03-134) to draft a groundwater management plan on August 26, 2003, after notice of
such hearing had been s duly published; and
WHEREAS, County staff prepared a draft Groundwater Management Plan that
was released for public review in April 2004 and placed in local libraries and on the Butte
County Department of Water and Resource Conservation web-site; and
WHEREAS, the County of Butte published a public notice of the availability of
the Public Review Draft -Butte County Groundwater Management Plan in local Butte
County newspapers in May 2004; and
WHEREAS, the Butte County Department of Water and Resource Conservation
received public comments to the draft Groundwater Management Plan through late
August 2004; and
WHEREAS, a resolution to schedule a hearing to adapt a groundwater
management plan was recommended to the Board of Supervisors by the Butte County
Water Commission on August 3, 2004; and
WHEREAS the Board of Supervisors a resolution (Resolution No. 04-152) to
schedule a hearing to adopt a groundwater management plan pursuant to Water Cade
Section 10750 et seq. for the purposes of hearing protests and adopting the plan and
establishing a groundwater management program at 10:30 am on September 28, 2004;
and
WHEREAS, the Clerk of the Board duly published a notice as required by Water
Code Section 10753.5; and
WHEREAS, the Department of Water and Resource Conservation has
documented suggested changes to the groundwater management plan, based on
comments received on the public review draft, pursuant to Water Code Section 10750 et
seq.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of the
County of Butte has reviewed the status of protests to the Butte County Groundwater
Management Plan, and seeing none, hereby agree to adopt the Butte County Groundwater
Plan pursuant to Water Code Section 10750 et seq. (AB 3030, Stats 1992) for the Areas
of Butte County not covered by another groundwater management plan under this
authority or any other authority, and modify the plan with the recommended changes
suggested by the Department of Water and Resource Conservation in their staff report.

28th day of September 2004 by the following vote:
AYES: Supervisors Dolan, Houx, Josiassen; Yamaguchi and Chair Beeler
