PURSUAN"f "hO SEC"PION 40508.5 CALIFORNIA VE}iICLE CODE
VIOLATION OF PROMISE TO APPEAR.
~,~,~}{EREAS, California Vehicle Code (C'VC~} section 40508.5 (Penalty Assessment; Violation of
Promise to Appear} allows for a penalty assessment in an amount of $15 upon every person who violates his
or her written promise to appear, or a lawfully granted continuance of his or her promise to appear in court
or before a person authorized to receive a deposit of bail, or who otherwise fails to comply with any valid
court order for a violation of any provision of the California Vehicle Code (CVC) or local ordinance adopted
pursuant to CVC;
~VIIERIAS, the assessment shall apply ~~hether or not a violation of section 40508 CVC is
concurrently charged or a warrant ol~arrest is issued pursuant to section 40515 CVC;
WHEREAS, the clerk of the court shall deposit the amounts collected under section 40508.5 CVC
in the county treasury and all money so deposited shall be used for the development and operation of an
automated county warrant system;
WI}EREAS, section 40508.5 CVC requires a resolution of the Board of Supervisors to require the
coul-ts to impose an assessment fee of tifteen dollars ($15);
NOW, THEREFORE. RE IT RESOLVED that the Butte County Superior Court is authorized to
increase the hail schedule amounts to reflect the amount of the assessment imposed by this resolution; and
BE I"f FURTHER RESOLVED that the Butte County Superior Court impose an assessment of
fifteen dollars ($15) pursuant to section 40508.5 CVC and that the funds collected he used as provided for in
section 40508.5 {d) CVC for the development and operation of an automated county warrant system, etc.
[ hereby certify that the foregoing is a true copy of the resolution adopted by the Butte County
Board of Supervisors in a meeting thereof held on the 14th day of December, 2004, by the following vote:
AYES: Supervisors Dolan, Houx, Josiassen, Yamaguchi and Chair Beeler
