HomeMy WebLinkAbout04-225~,.+0~ SUP~+'••. • ~........~.,, •i •~ ,q .•' '•. t~, ~. i '~'o' ~•+.tl' i ice' ~~ :t/1 M • - y r * • iS • 'G ~~** •~~Ir_Qv V _ ~.~~+ ReSO~Zt.t20Y1 N0. 04-225 RESOLUTION TOR SUR'IMARY VACATION I; OR A PORTION Or A STORM DRAIN EASEMENT WITHIN FLORAL GARDEN ESTATES SUBDIVISION, PHASE I IN THE CITY OF CH[CO WHEREAS, portions of that Storm Drai11 Easement as granted to the County of Butte i11 those Casement Agreements recorded December 20, 1990, as instrument numbers 90-54218 and 90-54220, Official Records of Butte County, are no longer necessary or required; and WHEREAS, plans and specifications have been approved by the County of Butte and the City of Chico, and an underground stone drainage system has been installed and accepted by said County and City; and WHEREAS, pursuant to said Easement Agreement, the Cowlty of Butte finds that the easement granted is in excess of that required to maintain the underground drainage system; and WHEREAS, there are no other public storm drainage facilities located within tl~iose portions of the storm drain easement to be vacated; and WHEREAS, pursuant to the Streets and I~ighways Code Section Division 9, Part 3, Chapter 4, commencing with Section No. 8333, the board finds that a portion of said Storm Drain Easement should be summarily vacated; NOS', THEREi'ORE, BE IT RESOLVED, by the Board of Supervisors of the County of Butte, State of California, as follows: Those portions of that Storm Iarain Casement as granted to the County of Butte in those Casement Agreements recorded December 20, 1990, as instrument numbers 90-54218 and 90-54220, Official Records of Butte County, as described in Exhibit A and shown on Exhibit B, attached hereto, are hereby summarily vacated and abandoned pursuant to the Streets and Highways Code Division 9, Part 3, Chapter 4, commencing with Section No, 8333; 2. That the Clerk of this Board shall cause a certified copy of the Resolution, with the seal of the Board of Supervisors of the County of Butte, State of California, to be recorded in the Office of the Recorder of the County of Butte, State of California. Page 1 of 2 3. That froth and after the date the Resolution is recorded, the said portions of the Storm Drain Easement vacated no longer constitute a public easement.
