Resolution No. 04-271
RESOLUTION AMENDING SECTION 13.01-1, ENTITLED
"REQUIREMENT CLASS 1", OF THE BUTTE COUNTY
IMPROVEMENT STANDARDS DATED JUNE 2002
WHEREAS, REVISED Improvement Standards far subdivisions, parcel maps
and site improvements pursuant to Chapter 20 of the Butte County Code was
adopted in June of 2002; and
WHEREAS, Chapter 13 deals with Fire Standards; and
WHEREAS, Section 13.01-1 deals with the creation of a fire department
Water Tender Fund based on the number of parcels created; and
WHEREAS, Article XXIII, Sections 252-267 will impose Development Impact
Fees for Fire Department Facilities, Vehicles and Equipment in the
unincorporated area of Butte County
Water tender fees are included in these
development impact fees;
NOW, THEREFORE, BE IT RESOLVED, that the following section 13.01-1 of
the Butte County Improvement Standards dated June 2002 is being amended as
follows:
"13.01-1 Requirement Class 1
Except for those areas designated as "high and very high"
hazards on the hazard severity index map, a pressurized water
supply for fire protection will not be required. The developer
will install an automatic fire sprinkler system in all new
residential structures in accordance with the National Fire
Protection Association standard for the installation of
sprinkler systems in one and two family dwellings and mobile
homes, NFPA Standard 13D."

NOW, THEREFORE, BE IT FURTHER RESOLVED, that as a result of section
3.01-1 Requirement Class I being amended, all funds left in the Battalion
#1 Water Tender Fund, Battalion #2 Water Tender Fund, Battalion #3 Water
Tender Fund, Battalion #4 Water Tender Fund, Battalion #5 Water Tender
Fund, Battalion #6 Water Tender Fund and Battalion #7 Water Tender Fund
will be transferred to the fire facilityjvehicle and equipment fund created
in Article XXIII, Section 3-275 of the Butte County Cade.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that this resolution will ga
into effect at the same time as Article XXIII, Chapter 3 entitled
"Development Impact Fees for Fire Facilities, Vehicles, and Equipment in
the Unincorporated Area of Butte County" goes into effect.
PASSED AND ADOPTED by the Board of Supervisors of the County of
Butte, State of California, on the 14th day of December 2004 by the
following votes:
AYES: Supervisors Dolan, Houx and Chair Beeler
NOES: Supervisors Josiassen and Yamaguchi
ABSENT : None
NOT VOTING : None
