HomeMy WebLinkAbout05-008~~••0~ 3UP,~'••. 4. . r' 4;. •.~ 4''• ; o .~ . ~' ~'~- • ,_y, '~ ~ GQ.• BOARD ~~ ~UPERrI'I~OR~' COUNTY OF BUTTE, STATE OF C/~LIFORNIA Resolution No. RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE TO RECEIVE A TRANSFER OF FUNDS FROM THE WESTERN CANAL WATER DISTRICT FROM A DESIGNATED PORTION OF THE 2003 CROP IDLING PROGRAM FUNDS WHEREAS, the Western Canal Water District {District) is a public agency formed and operating pursuant to Division 13 of the California Water Code; and WHEREAS, during the 2003 irrigation season the District entered into an agreement to sell conserved water derived from idled acreage to Metropolitan Water District (MWD) per the OPTION AND PURCHASE AGREEMENT FOR WATER TRANSFER BETWEEN RICHVALE IRRIGATION DISTRICT AND METROPOLITAN WATER DISTRICT OF SOUTHERN CALIFORNIA; and WHEREAS, MWD is a public agency formed and operating under the Metropolitan Water District Act, 1969 Ca1.Stat. 492, Ch. 209 e'! seq. as amended, and is empowered to purchase water from District as provided for in that agreement; and WHEREAS, the Agreement allowed for MWD, a willing purchaser, to acquire from District water supplies that MWD had determined were needed for use in MWD's service area, and that water supplies transferred under that agreement were a portion of the water available to District under its diversion agreement with the State of California, acting by and through its Department of Water Resources; and WHEREAS, the water made available for transfer under the Agreement resulted from crop idling undertaken by landowners and growers within District's boundaries lying within Butte and Glenn Counties; and WHEREAS, in accordance with amended Paragraph 4 (d) of the Agreement, MWD was obligated to pay to District an additional amount of $16.50 per acre as a fund to assist the County, in its discretion, in the management and monitoring of water resources; and WHEREAS, District, in turn, agreed to turn over the amount of said funds derived from crop idling within Butte County to the County of Butte based on the amount of participating acres within Butte County; and 05-008 1~,miller'~Pallotiring .lgrccmenis~,RI~,SOLl I'1'ION-Rcccivc funds Gam WCWll WHEREAS, District and MWD amended this Agreement in September 2003 to address the transfer of funds for the County's discretionary use in the management and monitoring of water resources; and WHEREAS, District reports that 4,480.1 acres of land within Butte County participated in the 2003 crop idling program; and WHEREAS, District and County agree that the total maximum amount of compensation arising under the 2003 crop idling program for the water transfer payable under this Agreement from District to Butte County is $73,921.65. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of the County of Butte hereby agree to Sign the Agreement between the Western Canal Water District and Butte County Department of Water Conservation (Department) for Transfer of a Designated Portion of the 2003 Idling Program Funds. 2. Direct the Department to set up the necessary funding account to receive funds (unanticipated revenue) in the total maximum amount of $73,921.65. PASSED AND ADOPTED by the Butte County Board of Supervisors this 11th day of January 2005 by the following vote: AYES: Supervisors Connelly, Dolan, Houx, Josiassen and Chair Yamaguchi NOES: None ABSENT: None NOT VOTING: None Kim K.
