Q" • •••••.~~COU•••'•~••G••~ Resolution No. 05-018 A RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS SUPPORTING RENEWAL OF THE CHICO/NORTHERN BUTTE COUNTY RECYCLING MARKET DEVELOPMENT ZONE WHEREAS, the California Public Resources Code Section 42010 provides for the establishment of the Recycling Market Development Zone (RMDZ) program throughout the State to provide incentives to stimulate development of post-conslmler and secondary materials markets for recyclables; and WHEREAS, the Chico/Northern Butte County Recycling Market Development Zone (RMDZ) includes unincorporated sections of the Colu~ty of Butte; and WHEREAS, cities and counties must meet a 50 percent reduction in landfill waste disposal as mandated in the California Integrated Waste Management Act; and WHEREAS, the Chico/Northern Butte County RMDZ is dedicated to establishing, sustaining and expanding recycling-based manufacturing businesses, which is essential for market development and to assist local jurisdictions to meeting the established landfill reduction goals; and WHERF,AS, the Chico/Northern Butte County RMDZ will expire in December 2004 ~u~less re-designated by the California Integrated Waste Management Board; and WHEREAS, the City of Chico still desires existing and new recycling-based manufacturing businesses locating within the region to be eligible for the technical and financial incentives associated with the RMDZ program; and WHEREAS, the renewal of the Chico/Northeri Butte County RMDZ is necessary to facilitate local and regional planning, coordination, support of existing recycling-based manufacturing businesses, as well as attract private sector recycling business investments to the region; and WHEREAS, the California Legislature has defined environmental justice as "the fair treatrnent of people of all races, cultures, and incomes with respect to the development, adoption, implementation, and enforcement of environmental laws, regulations, and policies" [Government Code section 65040.12(e)], and has directed the California Environmental Protection Agency to conduct its programs, policies, and activities that substantiality affect human health or the enviroml~ent in a manner that ensures the fair treatment of people of all races, cultures, and income levels, i-lcluding minority and low-income populations of the state [Public Resources Code section 71 1 10(a)]; and WHEREAS, the California Integrated Waste Management Board, in its Strategic Plan, has adopted a goal to continuously integrate environmental justice concerns into all of the Board's programs and activities; and WHEREAS, the City of Chico, as Lead Agency, prepared a Negative Declaration pursuant to the California Enviromnental Quality Act in 1992 as part of the City's Source Reduction and Recycling Element (SRRE) as required by the California Integrated Waste Management Act (AB 939); and WHEREAS, the potential environmental impacts resulting from the establishment of the RMDZ were analyzed by the City of Chico as part of the Initial Study/Negative Declaration prepared for the SRRE; and WHEREAS, the County of Butte has reviewed and considered the Negative Declaration prepared by the City of Chico and finds that no new significant environmental impacts will result from the renewal of the RMDZ. NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE HEREBY: 1. Approve the sub-r-ittal of an application for renewal of the Chico/Northern Butte County RMDZ by the City of Chico to include unincorporated portions of Butte County. 2. Agrees to administer the RMDZ program in a manner that seeks to ensure the fair treatment of people of all races, cultures, and incomes, including but nor limited to soliciting public participation in all communities within the RMDZ. The foregoing resolution was adopted by the Butte County Board of Supervisors at its meeting held on the 25`}' of January, 2005 by the following vote: AYES: Supervisors Connelly, Dolan, Houx, Josiassen and Chair Yamaguchi NOES: None ABSENT: None NOT VOTING: None 1 ; ~~ Kim Yamaguchi, Board Chairman ATTEST: PAUL MCINTOSH, Chief Administrative Officer And Clerk of the Board of Supervisors
