RESOLUTION GIVING NOTICE OF HEARING ON PETITION
TO ABANDON A PORTION OF A DRAINAGE EASEMENT
WHEREAS, this Board has received a petition from five or more free-holders,
requesting the abandonment of a portion of a drainage easement as described below, and at least
one of the petitioners is a resident of the road district in which said drainage easement is situated;
and
WHEREAS, pursuant to Chapter 3 of Part 3 of Division 9 of California Streets and
Highways Code (commencing with Section 8320) this Board shall set a date, hour and place for
a hearing on the petition for abandonment.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors:
1. That this board hereby gives notice that at its regular meeting on March 22, 2005,
at 10:30 a.m., in the Board Chambers, Butte County Administration Building, 25 County Center
Drive, Oroville California, a hearing shall be held to hear all persons interested in the
abandonment of that certain drainage easement located on a vacant lot on the East side of Jack
Hill Drive, 130' south of 6336 Jack Hill Drive, Kelly Ridge Area, more particularly described as
follows:
Commencing at the Southerly most corner of Lot 505 as shown on the Subdivision Map
of Kelly Ridge Estates Unit 4C as filed in the Butte County, California Recorders Office
in Book 66 of Maps at Page 12; thence North 41° 10' 34" East, along the Easterly line of
said Lot 505, 7.00 feet to the TRUE POINT OF BEGINNING for the herein described
parcel of land; thence leaving said Easterly line North 51° 04' S0" West, parallel to the
Southerly line of said Lot 505,100.09 feet to a point on the Westerly line of said Lot 505;
thence North 29° 06' 46" East along said Westerly line, 13.19 feet; thence leaving said
Westerly line South 51° 04'50" East parallel to said Southerly line, 102.84 feet to a point
on the Easterly line of said Lot 505; thence South 41 ° 10' 34" West along said Easterly
line, 13.01 feet to the point of beginning.
Containing 1319.05 square feet more or less.
The Basis of Bearings for this description is the same as shown on said Kelly Ridge
Estates Unit 4C Subdivision Map.
2. That a map showing the public service easement to be abandoned is on file in the
Office of the Butte County Department of Public Works, 7 County Center Drive, Oroville,
California 95965
3. That at the conclusion of said hearing the Board intends to abandon said drainage
easement.
4. That this abandonment proceeding is being conducted pursuant to Chapter 3 of
Part 3 of Division 9 of the California Streets and Highways Code (commencing with Section
8320).
5. That this Resolution be posted and published pursuant to the provisions of
Chapter 3 of Part 3 of Division 9 of the California Streets and Highways code.
