RESOLUTION ABANDONING A PORTION OF A DRAINAGE EASEMENT
IN LOT 505, KELLY RIDGE ESTATES, UNIT 4C SUBDIVISION
WHEREAS, this matter came on regularly for hearing before the Board of Supervisors
of the County of Butte, State of California, on March 22, 20005, in the Board Chambers, Butte
County Administration Building, 25 County Center Drive, Oroville, California; and
WHEREAS, it appearing to said Board that notice of the time and place of the hearing
on the petition for the abandonment of the drainage easement in question was duly and regularly
given as required by law; and,
WHEREAS, testimony and evidence, both oral and documentary, having been produced
at said hearing, from which said Board now finds that: (1) there is no possibility the proposed
abandonment of this drainage easement may have a significant effect on the environment, and it
is therefore not subject to the California Environmental Quality Act; (2) the proposed
abandonment is in conformance with the Butte County General Plan; and (3) the drainage
easement in question, as hereinafter described, is unnecessary for present or prospective public
use.
NOW, THEREFORE, IT IS HEREBY ORDERED as follows:
1. That the drainage easement situated in the County of Butte, State of California, as
hereinafter more particularly described, is hereby abandoned pursuant to Chapter 3 of Part 3 of
Division 9 of the California Streets and Highways Code, commencing with Section 8320.
2. That said drainage easement so abandoned is located in the unincorporated area of
the County of Butte, State of California, in the Kelly Ridge Area, in the Kelly Ridge Estates,
Unit 4C Subdivision, identified as a portion of Assessor's Parcel Number 069-280-053, and is
described as follows:
Commencing at the Southerly imost corner of Lot 505 as shown on the Subdivision Map
of Kelly Ridge Estates Unit 4C as filed in the Butte County, California Recorders Office
in Book 66 of Maps at Page 12; thence North 41° 10' 34" East, along the Easterly line of
said Lot 505, 7.00 feet to the TRUE POINT OF BEGINNING for the herein described
parcel of land; thence leaving said Easterly line North 51° 04' S0" West, parallel to the
Southerly line of said Lot 505,100.09 feet to a point on the Westerly line of said Lot 505;
thence North 29° 06' 46" East along said Westerly line, 13.19 feet; thence leaving said
Westerly line South 51° 04'50" East parallel to said Southerly line, 102.84 feet to a point
on the Easterly line of said Lot 505; thence South 41° 10' 34" West along said Easterly
line, 13.01 feet to the point of beginning.
Containing 1319.05 square feet more or less.
The Basis of Bearings for this description is the same as shown on said Kelly Ridge
Estates Unit 4C Subdivision Map.
3. That a map showing the Drainage Easement hereby abandoned is on file in the
Office of the Butte County Department of Public Works, 7 County Center Drive, Oroville,
California 95965.
4. That the Clerk of this Board shall cause a certified copy of this Resolution, with
the seal of the Board of Supervisors of the County of Butte, State of California, to be recorded in
the Office of the Recorder of the County of Butte, State of California.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 22°`~ day of
March, 2005, by the following vote:
