RESOLUTION INCREASING THE SETTLEMENT
AUTHORITY OF CLAIMS REVIEW COMMITTEE
WHEREAS, on July 11, 1995 the Board of Supervisors of the
County of Butte adopted Resolution ##95-100, which established a
Claims Review Committee pursuant to California Government Code
section 935.2; and
WHEREAS, Resolution #95-100 authorized the Claims Review
Committee to reject or settle claims against the County that
sought damages of $5,000 or less without the Board's approval;
and
WHEREAS, Resolution #95-100 established a procedure for the
Claims Review Committee to follow in determining whether to
reject or settle claims seeking damages of $5,000 or less; and
WHEREAS, Resolution #95-100 provided that the Claims Review
Committee is to provide recommendations to the Board of
Supervisors for claims seeking damages of more than $5,000; and
WHEREAS, a survey of other counties indicates that Claims
Review Committees in those counties (Shasta, El Dorado, Yolo,
Sonoma, Stanislaus, Santa Clara, Sacramento) have the authority
to settle claims for $25,000 to $50,000 without their Board's
approval; and
WHEREAS, the majority of civil claims against the County
seek damages in the range of $10,000 to $25,000, and the
requirement of presenting to this Board all settlement offers for
such claims causes a delay in the Committee's ability to relay
and respond to settlement offers in a timely manner, especially
in circumstances where negotiations are ongoing.
NOW, THEREFORE, BE IT RESOLVED by the Butte County Board of
Supervisors:
1. That the Claims Review Committee is hereby authorized
to reject or settle claims that do not exceed $25,000.
2. That the Claims Review Committee shall make
recommendations to the Board of Supervisors regarding
the settlement or rejection of claims alleging damages
in excess of $25,000.
3. Warrants may be drawn upon the Service Fund subject to
the procedures approved by the Auditor-Controller and
the Claims Review Committee for the settlement of
claims and for payment thereof, in amounts not to
exceed $25,000.
4. Fees for outside legal services, claims adjusting
services and other related program expenses will
continue to be paid from the Service Fund, subject to
proper documentation.
PASSED AND ADOPTED by the Butte County Board of Supervisors
this 271` day of August, 2005, by the following vote:
