RESOLUTION INCREASING THE SETTLEMENT
AUTHORITY OF DESIGNATED PERSONS
WHEREAS, Government Code Sections 935.2 and 935.4 allow a Board of
Supervisors to authorize a specific individual, or a Claims Review Committee of three or
more individuals to settle or compromise claims made against the County; and
WHEREAS, Chapter 30 of the Butte County Policy & Procedures Manual,
adopted March 23, 1982, establishes the County Administrative Office or his or her
delegate, the Risk Management Coordinator, and the Personnel Director as the persons
designated by the Board of Supervisors with the authority to resolve workers'
compensation claims against the County of Butte for $10,000 or less, without obtaining
the Board of Supervisors' approval; and
WHEREAS, the Butte County Board of Supervisors wishes to increase the
settlement authority of previously designated persons to reduce delays in settling claims
seeking damages of more than $10,000, but less than $25,000.
NOW, THEREFORE, BE IT RESOLVED by the Butte County Board of
Supervisors, that the County Administrative Officer or his or her delegate, the Risk
Management Coordinator, and the Personnel Director shall have the authority to resolve
workers' compensation claims against the County of Butte for $25,000 or less, without
obtaining the Board of Supervisors' approval, and Chapter 30 of the Butte County Policy
& Procedures manual shall be amended to reflect this change.

day of August 2005, by the following vote:
