RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE
AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO NEGOTIATE AND
ENTER INTO AGREEMENT FOR ACQUISITION OF REAL PROPERTY FOR
PUBLIC ROAD PURPOSES AND AGREEMENTS FOR STORM DRAINAGE, PUBLIC
SERVICE, AND TEMPORARY CONSTRUCTION EASEMENTS FOR THE
OPHIR ROAD AND LINCOLN BOULEVARD SIGNALIZATION PROJECT,
COUNTY PROJECT NUMBER 21461-98-2
WHEREAS, the Butte Cowlty Department of Public Works is charged with the
responsibility for studying, recommending, constructing, and maintaining traffic control
measures within the system of County of Butte roadways; and
WHEREAS, the Butte County Department of Public Works has previously determined
that traffic signal warrants have been met at the Ophir Road and Lincoln Boulevard intersection
as established in the State of California Department of Transportation (Caltrans) Traffic Manual;
and
WHEREAS, the Butte County Board of Supervisors are charged with legally
establishing traffic control measures within the system o~f County of Butte roadways through
ordinances enacted in concurrence with the California Vehicle Code; a~1d
WHEREAS, the Butte County Board of Supervisors have approved the installation of a
traffic signal at Ophir Road and Lincoln Boulevard Signalization Project based on the
recommendations of the Butte County Department of Public Works; and
WHEREAS, the County of Butte and the Department of Public Works 11as pursued and
been awarded grant funding through both the County of Butte Indian Gaming Local Community
Benefit Committee grant application process and the federal Congestion Mitigation and Air
Quality Improvement Program (CMAQ) to pursue and construct the proposed Ophir Road and
Lincoln Boulevard Signalization Project; and
WHEREAS, the County of Butte must complete all right of way and easement
acquisitions and deliver a Right of Way Certification to Caltrans Local Assistance and the
Federal Highway Administration by April 2006 to receive allocation of the construction funding
by the California Transportation Committee (CTC), as programmed.
NOW THEREFORE. BE IT RESOLVED, by the Board of Supervisors of the County
of Butte, State of California, in order to expedite the delivery of the Right of Way Certification
to the State and the Federal Highway Administration, authorizes the Director of Public Works to
negotiate and sign the Agreement for Acquisition of Real Property for Road Purposes,
Agreement for Storm Drainage Easements, Agreement for Public Service Easements, and
Agreement for Temporary Construction Easements for the Ophir Road and Lincoln Boulevard
Signalization Project, County Project No. 21461-98-2.

California, this 8th day of November , 2005, by the following vote:
