RESOLUTION INCREASING THE DISTRIBUTION OF UNIFORM FILING
FEES TO THE BUTTE COUNTY LAW LIBRARY
WHEREAS, California Business and Professions Code Section 6321, subdivision (a), establishes
the amount to be distributed to the Butte County law library fund from the newly established state
uniform filing fee at twenty-nine dollars ($29.00); and
WHEREAS, the Butte County Public Law Library does not receive enough revenue from its
portion of filing fees as established by California Business and Professions Code Section 6321,
subdivision (a), to maintain the library collection and public service operations due to the documented
decrease in the number of paid filings in 2004 and in 2005; and
WHEREAS, this year, the Butte County Board of Supervisors is empowered by California
Business and Professions Code Section 6321, subdivision (b), to increase the amount distributed to the
Butte County law library fund by up to three dollars ($3.00) if it determines that the increase is necessary
to defray the expenses of the Butte County Public Law Library; and
WHEREAS, the Butte County Board of Supervisors determines that athree-dollar ($3.00)
increase in the amount to be distributed to the Butte County law library fund is necessary to defray the
expenses of the Butte County Public Law Library.
NOW, THEREFORE, BE IT RESOLVED, that the Butte County Board of Supervisors
requests that the amount distributed to its Butte County law library fund from the state uniform filing fee,
as referenced in California Business and Professions Code Section 6321, subdivision (a), be increased by
three dollars ($3.00) to thirty-two dollars ($32.00), effective January 1, 2006.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of
California, on the 8`f' day of November 2005 by the following vote:
AYES: Supervisors Connelly, Dolan, Houx, Josiassen and Chair Yamaguchi
