AND REQUEST THE GOVERNOR PROCLAIM THE COUNTY OF BUTTE TO BE IN
A STATE OF EMERGENCY
WHEREAS, Section S-5 of the Butte County Code empowers the Chief Administrative
Officer of the County of Butte to proclaim the existence, or threatened existence of a local
emergency when said County is affected, or likely to be affected, by a local emergency and the
Board of Supervisors is not in session; and
WHEREAS, conditions of extreme peril to the safety of persons and property have
arisen within said County, in that commencing on or about 3:15 pm on Saturday, December 31,
2005, caused by torrential rain, wind and flooding; and
WHEREAS, the aforesaid conditions of extreme peril did warrant and necessitate the
proclamation of the existence of a local emergency; and
WHEREAS, at the time of the commencement of the said local emergency the Board of
Supervisors was not in session {and could not immediately be called into session}; and
WHEREAS, the Chief Administrative Officer of the County of Butte did proclaim the
existence of a local emergency within said County on the 315C day of December 2005; and
WHEREAS, it is hereby found that Iocal resources are unable to cope with the effects of
said emergency.
NOW, THEREFORE, IT IS HEREBY PROCLAIMED AND ORDERED that the
Proclamation of Existence of a Local Emergency and request to the Governor to declare a State
of Emergency, as issued by said Chief Administrative Officer, is hereby ratified and confirmed
by the Board of Supervisors of the County of Butte; and
IT IS FURTHER PROCLAIMED AND ORDERED that the Proclamation of
Existence of a Local Emergency shall be deemed to continue to exist until its termination is
proclaimed by the Board of Supervisors of the County of Butte; and
IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said
local emergency the powers, functions and duties of the emergency organization of this County
shaIi be those prescribed by state law, by charter, ordinances, and resolutions of this County, and
by the County of Butte Emergency Plan; and
IT IS FURTHER ORDERED that a copy of this resolution be forwarded to the State
Director of the Office of Emergency Services; and
IT IS FURTHER ORDERED that John H. Gulserian, Emergency Services Officer of
the County of Butte, is hereby designated as the authorized representative of the County of Butte
for the purpose of receipt, processing, and coordination of all inquiries and requirements
necessary to obtain available State and Federal assistance.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 6`~ day of
January 2006 by the following vote:

PROCLAMATION OF EXISTENCE OF A LOCAL EMERGENCY

WHEREAS, Section 8-5 (I) of the Butte County Code empowers the Chief
Administrative Officer of the County of Butte, in fhe absence of the Board Chair and Vice
Chair, to proclaim the existence or threatened existence of a local emergency when said
County is affected or likely to be affected by a public calamity and the Board of
Supervisors is not in session, and;
WHEREAS, the ChiefAdminisfrative Officer of the County of Butte does hereby
find; That conditions of extreme peril to the safety of persons and property have arisen
within said county, caused by torrential rain, wind and flooding; which began on the 31st
day of December, 2005, and;
WHEREAS, that these conditions are or are likely to be beyond the control of the
services, personnel, equipment, and facilities of said County, and;
WHEREAS, that the County Board of Supervisors of the County of Butte is not in
session and cannot immediately be called into session;
NOW, THEREFORE, IT IS HEREBY PROCLAIMED that a local emergency now
exists throughout said County, and;
IT lS FURTHER PROCLAIMED AND ORDERED that during the existence of
said local emergency the powers, functions, and duties of the emergency organization of
this County shall be those prescribed by state law, by ordinances, and resolutions of this
County, and; That this emergency proclamation shall expire in 7 days after issuance
unless confirmed and ratified by the governing body of the County of Butte.
