RESOLUTION FOR SUMA~IARY VACATrON
FORA
WATER PIPELINE RIGHT OF WAY
FROM THE MIOCENE CANAL TO THE OLD COUNTY INFIRMARY
WHEREAS, that Water Pipeline Right of Way from the Miocene Canal (formerly
known as the Powers Ditch) to the old County Infirmary, as granted to the County of Butte in
that instrument dated March 2, 1886, and recorded in Book 26 of Deeds at page 157, Official
Records of Butte County, is no longer necessary or required; and
WHEREAS, the Water Pipeline Right of Way has not been used for the purpose for
which it was acquired for five consecutive years preceding the date of this resolution; and
WHEREAS, the Water Pipeline Right of Way has been superseded by relocation as
evidenced by existing public water facilities within public rights of way currently serving the old
County Infirmary building; and
WHEREAS, pursuant to the Streets and Highways Code Division 9, Part 3, Chapter 4,
commencing with Section No. 8330, the Board finds that said Water Pipeline Right of Way
should be summarily vacated;
NOW, THEREFORE, BE TT RESOLVED, by the Board of Supervisors of the County
of Butte, State of California, as follows:
That Water Pipeline Right of Way from the Miocene Canal (formerly known as the
Powers Ditch} to the old County Infirmary, as granted to the County of Butte in that instrument
recorded March 2, 1886, in Book 26 of Deeds at page 157, Official Records of Butte County and
located in Section 6, Township 19 North, Range 4 East, M.D.B. & M. is hereby summarily
vacated and abandoned pursuant to the Streets and Highways Code Division 9, Part 3, Chapter 4,
commencing with Section No. 8330;
And from and after the date this Resolution is recorded, said Water Pipeline Right of
Way vacated no longer constitutes a public easement.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 11th day of
April, 2006, by the following vote:
AYES: Supervisors Connelly, Dolan, Houma,
