AND THEIR SPHERES OF INFLUENCE
WHEREAS, the Butte County Public Works Department has been notified by the Butte
Local Agency Formation Commission that the following County Service Areas (CSAs), CSA 88
-Heritage Estates Lighting & Drainage and CSA 154 - Forebay Vista Lighting & Drainage are
not providing any of their intended services, and
WHEREAS, in addition County Service Areas 113 -- Pleasant Valley Industrial Park
Lighting & Drainage, CSA 118 -Watkins Subdivision Lighting & Drainage, and CSA 144 -
Durham Vintage Estates Lighting & Drainage have also been determined to not be providing any
of their intended services, and
WHEREAS, these CSA accounts do not have a current budget or established maximum
per parcel service charges, and
WHEREAS, the Butte Local Agency Formation Commission has requested the Butte
County Board of Supervisors initiate the County's intent to dissolve any CSA accounts if they
: were not deemed necessary; and
WHEREAS, the Butte Local Agency Formation Commission has notif ed the County
that their fees associated with the dissolution of said CSAs will be waived; and
WHEREAS, the dissolution of said CSAs are categorically exempt from CEQA under
section 15320, and
WHEREAS, any request to dissolve a CSA and its co-terminus Sphere of Influence in
accordance with the Cortese-Knox Local Government Reorganization Act of 1985, as set forth in
Division 3, Title 5 of the California Government Code must be processed through the Butte
County Local Agency Formation Commission {LAFCo); and
RESOLUTION OF APPLICATION REQUESTING DISSOLUTION OF
WHEREAS, the reason for the proposed dissolution of County Service Areas {CSAs}
CSA 88 -Heritage Estates Lighting & Drainage, CSA 113 -Pleasant Valley Industrial Park
Lighting & Drainage, CSA 118 -Watkins Subdivision Lighting & Drainage, CSA 144 -
Durham Vintage Estates Lighting & Drainage and CSA 154 - Forebay Vista Lighting &
Drainage which were formed to provide storm drainage maintenance and future street lighting is
that the corporate powers of said County Service Areas have not been used and there is a
reasonable probability that they will not be used in the future. Services or facilities of substantial
benefit have not been provided to the residents or landowners of said County Service Areas.
NOW, THEREFORE BE YT RESOLVED, this Resolution of Application is hereby
adopted and approved by the Board of Supervisors, and the Butte County Local Agency
Formation Commission is hereby requested to take proceedings for the dissolution of County
Service Areas {CSAs) CSA 88 -Heritage Estates Lighting & Drainage, CSA 113 -Pleasant
Valley Industrial Park Lighting & Drainage, CSA I18 -Watkins Subdivision Lighting &
Drainage, CSA 144 -Durham Vintage Estates Lighting & Drainage, and CSA 154 - Forebay
Vista Lighting & Drainage, according to the terms and conditions stated above and in the manner
provided by the Cortese-Knox Local Government Reorganization Act of 1985.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of
California, this 1 lt~' day of April, 2006 by the following vote:
AYES: Supervisors Connelly, Dolan, Houma, Yamaguchi and Chair Josiassen
NOES: None
ABSENT: None
NOT VOTING: None
