HomeMy WebLinkAbout06-115Resolution No. A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE CONSOLIDATING AN ELECTION FOR SPECIAL TAX MEASURES TO BE HELD IN THE CITIES OF BIGGS AND GRIDLEY WITH THE GENERAL STATEWIDE ELECTION TO BE HELD NOVEMBER 7, 2006 WHEREAS, the City of Biggs has called a general election and included two ballot measures on the ballot has requested that the Board consolidate the City of Biggs election with the General statewide election to be held on November 7, 2006, and that the City's two ballot measures be included on the ballot and that the ballot questions, be numbered and designated by the County of Butte as City Council proposed ballot measures; and . WHEREAS, pursuant to Elections Code section 1300 and Biggs Municipal Code section 2.05.020, the City of Biggs' general election is to be held at the same time as the statewide general election and said date for bath is set forth in Elections Code 1200, and for this year, 2006, is November 7, 2006; and WHEREAS, the two ballot measures the City of Biggs desires to submit to the voters of the City of Biggs for their approval and adoption at the general election to be held in the City on November 7, 2006, are as follows: 1. A ballot measure to adopt a special property tax and spending limuit increase for City police services. 2. A ballot measure to adopt a special property tax and spending limit increase for stand-by costs of providing emergency room services in a critical access hospital (Biggs-Gridley Memorial Hospital); and WHEREAS, the City of Gridley has called a general election and included one ballot measure on the ballot and has requested that the Board consolidate the City of Gridley election with the General statewide election to be held on November 7, 2006, and that the City's ballot measure be included on the ballot and the ballot question be numbered and designated by the County of Butte, as a City Council proposed ballot measure; and WHEREAS, pursuant to Elections Code section 1300 and Gridley Municipal Code section 1.16.010, the City of Gridley's general election is to be held at the same time as the statewide general election and said date for both is set forth in Elections Code 1200, and for this year, 2006, is November 7, 2006; and 1 9~' ` Q~'! °z~- WHEREAS, the ballot measure the City of Gridley desires to submit to the voters of the City of Gridley for their approval and adoption at the general election to be held in the City on November 7, 2006, is as follows: 1. A ballot measure to adapt a special property tax and spending limit increase for standby-costs of providing emergency room services in a critical access hospital (Biggs-Gridley Memorial Hospital); and WHEREAS, November 7, 2006 is the date of the State's, the County's and both Cities' general statewide election; and WHEREAS, it is desirable that the Butte County Department of Elections canvas the returns of the consolidated election and that the election be handled in all respects as if it were only one election; and WHEREAS, pursuant to the requirements of Elections Code section 10401, the Board of Supervisors may order consolidation of the above referenced elections; and WHEREAS, if the aforementioned elections in the cities of Biggs and Gridley are consolidated with the general statewide election to be conducted on November 7, 2006, the cities of Biggs and Gridley are required to reimburse the County for all of the services provided for the aforementioned elections in the cities of Biggs and Gridley, pursuant to the requirements of Elections Code section 10002; and WHEREAS, Board of Supervisors desires to order consolidation of the above referenced elections pursuant to the authority vested in the Board by Elections Code section 10401; and, NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of the County of Butte, State of California, as follows: Section 1. Call of Election. The Board hereby calls an election at which the questions of the approval of the proposed special taxes and spending limit increases shall be submitted to the registered voters within the cities of Biggs and Gridley. The election shall be held on November 7, 2006. Pursuant to the provisions of California Elections Code Section 10002, the Board of Supervisor authorizes and directs the Butte County Clerk/Recorder to serve as the election official conducting this election in all respects and to consolidate this election with the regular election to be held on that date. The costs of the election in the City of Biggs shall be borne by the City of Biggs. The costs of the election in the City of Gridley shall be borne by the City of Gridley. Pursuant to Elections Code sections 10400 et seq., the election for this measure shall be consolidated with the general statewide election to be conducted on November 7, 2006. 2 Section Z. Order of Consolidation. Pursuant to the requirements of Elections Cade section 10401, the Board of Supervisors of the County of Butte orders the consolidation of the two aforementioned elections with the general statewide election to be conducted on November 7, 2006. Section 3. Election Services. Pursuant to the provisions of California Elections Code Section 10002, the Board does hereby authorize and direct the County C1erk/Recorder to perform necessary services in connection with the aforementioned City of Biggs and City of Gridley elections. Section 4. Filing of Resolution. The Board hereby authorizes and directs the Clerk of the Board of Supervisors to file with the Butte County C1erk/Recorder certified copies of this resolution. Section 5. Questions Submitted to the Voters. The Butte County C1erk/Recorder is hereby requested to include the following ballot measures on the ballot, and the relevant voter pamphlet information, as set forth hereinafter, and that the following ballot questions, to be numbered and designated by the County of Butte as City Council proposed ballot measures, are to appear as follows: A. City of Biggs: Shall a special property tax for police protection services within the City of Biggs in the amount $150 per parcel containing one or more residential structures ar one or more commercial structures (vacant parcels shall not be subject to the tax}, and a corresponding increase in the City's spending limit, as established by City Resolution _-06, be approved? YES NO Shall a special property tax to fund stand-by costs of providing emergency room services at the Biggs-Gridley Hospital, in the amount $70 per residential equivalent unit per year for ten years (vacant parcels and parcels without residential units shall not be subject to the tax), as enacted by Biggs Resolution 2006-_, and Ordinance , and a corresponding increase in the City's spending limit, be approved? YES NO B. City of Gridley: Shall a special property tax to fund stand-by costs of providing emergency room services at the Biggs-Gridley Hospital, in the amount $70 per residential equivalent unit per year for ten years (vacant parcels anal parcels without residential units shall not be subject to the tax), as enacted by Gridley Resolution 2006 ,and Ordinance , and a corresponding increase in the City's spending limit, be approved?
