RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE
AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO NEGOTIATE AND
ENTER INTO AGREEMENTS FOR ACQUISITION OF REAL PROPERTY FOR
PUBLIC ROAD PURPOSES AND PERMISSION TO ENTER AND CONSTRUCT
IMPROVEMENTS FOR PROPERTY OWNER'S BENEFIT FOR THE
DURHAM~PENTZ ROAD AND BUTTE CAMPUS DRIVE
SIGNALIZATION PROJECT,,
COUNTY PROJECT NUMBER 43341-06-1
WHEREAS, the Butte .County Department of Public Works is charged with the
responsibility for studying, recommending, constructing, and maintaining traffic control
measures within the system of County of Butte roadways; and
WHEREAS, the Butte County Department of Public Works has previously determined
that traffic signal warrants have been met at the Durham-Pentz Road and Butte Campus Drive
intersection as .established in the State of California Department of Transportation (Caltrans}
Traffic Manual; and
WHEREAS, the Butte County Board of Supervisors are charged with legally
establishing traffic control measures within the system of County of Butte roadways through
ordinances enacted in concurrence with the California Vehicle Code; and
WHEREAS, the Butte County Board of Supervisors have approved the installation of a
traffic signal of Durham-Pentz Road and Butte Campus Drive based on the recommendations of
the Butte County Department of Public Works and the request of.governing board of the Butte-
Glenn Community College District {Butte College District); and
WHEREAS, the County of Butte and the Department of Public Works has designated
County Traffic Impact Fees as the County of Butte funding to be utilized to pursue and construct
the proposed Durham-Pentz Road and Butte Campus Drive Signalization Project; and
WHEREAS, the Butte County Board of Supervisors have authorized the Director of the
Department of Public Works to enter into a reimbursement agreement with the Butte College
District to reimburse the County of Butte fifty (50) percent of the cost of installation of a traffic
signal at Durham-Pentz Road and Butte Campus Drive; and
WHEREAS, the County of Butte must negotiate and complete all right of way
acquisitions and permission to enter and construct for property owner benefit prior to
construction of the proposed Durham-Pentz Road and Butte Campus Drive Signalization Project.
NOW THEREFORE. BE TT RESOLVED, by the Board of Supervisors of the County
of Butte, State of California, in order to expedite the acquisition of the right of way and
execution of agreements for temporary construction access, authorizes the Director of Public
Wor1CS to negotiate and sign the Agreements for Acquisition of Real Property for Road Purposes
and Permission to Enter and Construct Improvements for Property Owner's Benefit for the
Durham-Pentz Road and Butte Campus Drive Signalization Project, County Project No. 43341-
p6-1.

California, this 12th day of December , 20Q6, by the following vote:
